On May 22, 2018, the Government of Vietnam issued Decree No. 81/2018/ND-CP detailing the Commercial Law on commercial promotion activities.
Merchants conducting promotions must comply with the following principles:
- Promotional programs must be carried out legally, honestly, publicly, transparently, and ensure the lawful rights and interests of consumers, merchants, organizations, or other individuals.- Merchants conducting promotional programs must ensure favorable conditions for customers who win prizes to receive their awards and are obligated to resolve complaints related to the promotional program.- Merchants conducting promotions are responsible for ensuring the quality of the goods and services being promoted and the goods and services used for promotion.- The implementation of promotions must ensure the following:- No conditions are imposed for customers to enjoy the promotion that requires them to relinquish, refuse, or exchange goods or services of other merchants or organizations;- No direct comparisons are made between their goods or services and those of other merchants, organizations, or individuals.- It is prohibited to use lottery results to determine winners or serve as a basis for awarding prizes in promotional programs conducted in the forms stipulated in Clause 5, Clause 6, and Clause 9, Article 92 of the Commercial Law.
Decree 81/2018/ND-CP came into effect on July 15, 2018.
