Principles for Implementing Preferential Policies for People with Meritorious Services to the Revolution and Their Relatives

Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution (Amended 2012) was promulgated on July 16, 2012. Notably, this document revises the regulations on the principles of implementing preferential policies for people with meritorious services to the revolution and their relatives as previously stipulated in the 2005 Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution.

Specifically, according to Clause 3, Article 1 of the Amended Ordinance on Preferences for Revolutionary Contributors 2012, which amends and supplements the Ordinance on Preferences for Revolutionary Contributors 2005, preference policies for revolutionary contributors and their relatives are implemented according to the following principles:

  1. Revolutionary contributors falling under the two categories specified in Clause 1, Article 2 of the Ordinance on Preferences for Revolutionary Contributors 2005 and onward are entitled to receive allowances and benefits for each category. Other regimes enjoy the preference level of one category, except in the cases specified in Clause 5, Article 10, Clause 5, Article 26, and Clause 5, Article 33 of the Ordinance on Preferences for Revolutionary Contributors 2005.

  2. When a revolutionary contributor dies, their relatives are entitled to monthly pension allowances and monthly care allowances according to the preference policies for revolutionary contributors.

    In the event that a revolutionary contributor falls under the two categories specified in Clause 1, Article 2 of the Ordinance on Preferences for Revolutionary Contributors 2005 and onward and dies, their relatives are entitled to pension allowances for one category.

    In the case that a relative receives pension allowances for two or more categories of revolutionary contributors and is eligible for additional monthly care allowances, they shall receive one additional monthly care allowance.

  3. Revolutionary contributors and relatives specified in Point e, Clause 2, Article 14, and Clause 2, Article 27 of the Ordinance on Preferences for Revolutionary Contributors 2005 who die, shall have the funeral expenses paid by the organizer of the funeral according to the rates stipulated by the law on social insurance.

    In case the individuals specified in this Clause are concurrently regulated by the Law on Social Insurance, the funeral expenses shall be borne by Social Insurance.
