According to Article 3 of Decree 178/2024/ND-CP, the principles for implementing policies are specified as follows:
- Ensure the leadership of the Communist Party, promote the supervisory role of the Vietnam Fatherland Front, political-social organizations, and the People during the implementation of policies.
- Ensure the principle of democratic centralism, objectivity, fairness, transparency, and in accordance with the law.
- Ensure that no later than five years from the effective date of the decision to organize the apparatus by the competent authority, the number of leading and management officials, as well as the number of officials and public employees, and employees in agencies, organizations, and units within the political system after arrangement are compliant.
- Ensure prompt and full payment of policies as regulated by law; use the state budget properly and effectively.
- Each agency, organization, and unit must review and comprehensively evaluate officials and public employees and employees fairly and objectively based on the assessment of qualities, capacities, performance, and fulfillment level of job position requirements of these individuals. Based on this evaluation, proceed to rearrange, streamline staffing, and implement policies for officials and public employees and employees.
- The leadership of the party committee, government, and heads of agencies, organizations, and units are responsible for assessing, filtering, selecting individuals for termination, in connection with structuring and improving the quality of the officials and public employees under their management to ensure operational efficiency, effectiveness, and success.
- An individual eligible for multiple policies in various documents is entitled to only the highest policy.
- Central ministries, boards, sectors, and local agencies, organizations, and units must allocate about 5% of officials and public employees within their staffing to grassroots duties.
The applicable subjects specified in Article 2 of Decree 178/2024/ND-CP include:
- Officials and public employees, and those working under labor contract policies in agencies, organizations, units, and armed forces due to restructuring of the organizational apparatus, administrative units at various levels (hereinafter referred to as organizational restructuring) as specified in Article 1 of Decree 178/2024/ND-CP, including:
+ Leadership and management officials and public employees;
+ Commune-level officials and public employees;
+ Individuals working under labor contract policies as set by labor law before January 15, 2019, and those working under labor contract policies applied as officials (hereinafter referred to as employees);
+ Officers, professional soldiers, defense workers, and public employees under the Vietnam People's Army;
+ Officers, non-commissioned officers receiving salaries, police workers, and contract workers receiving salaries funded by the state budget under the People's Public Security;
+ Individuals working in cryptographic organizations.
- Officials lacking the qualification regarding age for re-election, reappointment to hold titles, and positions on a term basis in agencies of the Communist Party of Vietnam, State, political-social organizations, and officials retiring voluntarily shall be implemented in accordance with other Government of Vietnam decrees.
