On September 26, 2024, the General Auditor issued Decision 1659/QD-KTNN on the Regulation for Implementing Democracy in the operations of the State Audit Office of Vietnam.
This Regulation prescribes the implementation of democracy in the operations of the State Audit Office of Vietnam, including the rights, obligations, and responsibilities of the head of the agency or unit, officials and public employees, and workers of the State Audit; information disclosure within the agency or unit; the discussion, decision-making, participation, inspection, and supervision by officials and public employees and workers; organization, duties, powers and activities of the People's Inspection Committee.
According to Article 2 of the Regulation attached to Decision 1659/QD-KTNN dated September 26, 2024, the implementation of democracy in the operations of the State Audit Office of Vietnam must adhere to the following principles:
- Ensure the rights of officials and public employees, workers to be informed, to contribute opinions, to decide, and to inspect and supervise the implementation of democracy within the agency or unit.- Ensure the leadership of the Party, agencies, and units, and the core role of the Trade Union and socio-political organizations in implementing democracy within the agency or unit.- Implement democracy within the framework of the Constitution and the law; ensure order and discipline, without hindering the normal activities of the agency or unit.- Protect the interests of the State, the legitimate rights, and interests of the agency or unit and its officials and public employees, workers.- Ensure transparency, and enhance accountability in the process of implementing democracy within the agency or unit.- Respect the contributions and promptly address the recommendations and reflections of officials and public employees, workers.
Article 6 of the Regulation lists prohibited acts in implementing democracy within the agency or unit of the State Audit, including:
- Creating difficulties, hassles, or obstructing, threatening officials and public employees, workers from implementing democracy within the agency or unit.
- Concealing, obstructing, retaliating, or lacking responsibility in addressing petitions, complaints, denunciations; disclosing information about whistleblowers or those providing information on violations related to implementing democracy within the agency or unit.
- Exploiting the implementation of democracy within the agency or unit to carry out acts violating national security, public order, social safety, and infringing on the interests of the State, legitimate rights, and interests of organizations and individuals.
- Exploiting the implementation of democracy within the agency or unit to distort, slander, cause conflict, incite violence, discriminate based on regions, genders, religions, ethnicities, causing damage to individuals, agencies, units, organizations.
- Forging documents, committing fraud, or using other tricks to falsify the results that officials and public employees and workers have discussed, decided, or contributed opinions on.
- Disclosing state secrets; disclosing information that is not permitted to be publicized of the audited units; disclosing information about the situation and results, conclusions, audit recommendations that are not permitted to be publicized as per the legal regulations and the State Audit.
