Decree 149/2018/ND-CP has just been promulgated by the Government of Vietnam on November 07, 2018, to specifically stipulate the principles of implementing grassroots democracy in the workplace.
Decree 149 stipulates that in the implementation of workplace grassroots democracy, the following principles must be ensured:
- Goodwill, cooperation, honesty, equality, transparency, and openness.- Respect for the legal rights and interests of employers and employees.- Implementation of grassroots democracy at the workplace must not contravene the law and social ethics.
Additionally, Decree 149 mentions the contents that employers must publicly disclose, including:
- The status of task execution, production, and business activities.- Internal rules, regulations, and other corporate documents related to the duties, rights, and legal interests of employees.- Collective labor agreements of the enterprise, industry collective labor agreements, and other collective labor agreements that the enterprise participates in.- Resolutions of the Workers' Conference.- The establishment and usage of the reward fund, welfare fund, and other funds contributed by employees (if any).- The deduction and submission of trade union fees, social insurance, health insurance, and unemployment insurance.- The status of implementing commendations, rewards, discipline, and handling complaints and denunciations related to the legal rights and interests of employees.
