Principles for determining the jurisdiction of the Government of Vietnam, the Prime Minister of the Government of Vietnam from March 1, 2025 are stipulated in the Law on Organization of the Government of Vietnam 2025.

On February 18, 2025, the National Assembly passed the Law on Organization of the Government of Vietnam 2025.
The duties, powers of the Government of Vietnam, Prime Minister of the Government of Vietnam, Ministers, Heads of ministry-level agencies are determined based on the principles of jurisdiction allocation specifically stipulated in Article 6 of the Law on Organization of the Government of Vietnam 2025 as follows:
- The Government of Vietnam is responsible for submitting to the National Assembly, the Standing Committee of the National Assembly decisions on content stipulated by the Constitution and fundamental, important issues under the jurisdiction of the National Assembly, those under the authority of the Standing Committee of the National Assembly as stipulated in the Law on Organization of the Government of Vietnam 2025;
- The Government of Vietnam is responsible for cooperating with People's Courts, People's Procuracies as stipulated by the Law on Organization of the Government of Vietnam 2025, Law on Organization of People's Courts 2024, Law on Organization of People's Procuracies 2014 and other related laws;
- The Government of Vietnam guides local governments to perform assigned tasks, powers; local governments actively decide, organize implementation and take responsibility for the delegated tasks and powers;
- The Government of Vietnam uniformly manages state activities across various sectors; assigns the scope of state management responsibilities to Ministries, ministry-level agencies, ensuring clear distinction of responsibilities of Ministers, Heads of ministry-level agencies as members of the Government of Vietnam and as heads of Ministries, ministry-level agencies;
- The Prime Minister of the Government of Vietnam is the head of the Government of Vietnam; leads the work of the Government of Vietnam and is accountable to the National Assembly for the activities of the Government of Vietnam and the tasks assigned, without deciding issues under the authority and responsibility of Ministers, Heads of ministry-level agencies regarding sectors, fields as assigned by the Government of Vietnam. If necessary, the Government of Vietnam, the Prime Minister of the Government of Vietnam directs and manages the resolution of issues within the duties, powers of Ministers, Heads of ministry-level agencies, local governments;
- Ministers, Heads of ministry-level agencies perform tasks, powers based on the principle of delegation, distribution, decentralization, and authorization as stipulated in the Law on Organization of the Government of Vietnam 2025, regulations on decentralization in the Law on Organization of Local Governments and other related laws;
- Delegation and decentralization must clearly define the entities, content, scope of tasks, powers, ensure public transparency, accountability, supervision, inspection, control of power according to the Constitution and laws;
- The regulation of functions, tasks, powers, responsibilities of the Government of Vietnam, Prime Minister of the Government of Vietnam and Ministries, ministry-level agencies in other legal normative documents must be consistent with the Law on Organization of the Government of Vietnam 2025, ensuring effective control of state power;
- Encourages central government agencies and local governments to proactively propose delegation, decentralization accompanied by mechanisms, policies, solutions to effectively implement delegation, decentralization aimed at promoting flexibility, creativity, resource liberation, economic-social development.
