Regarding this issue, LawNet would like to answer as follows:

On October 30, 2023, the Minister of Education and Training issued Circular 20/2023/TT-BGDDT providing guidance on job positions, structure of public employees according to professional titles, and quotas on the number of people working in general education establishments and public specialized schools.

Principles for determining job positions and quotas for the number of people working at public schools in Vietnam

Determining job positions and the number of people working in public general education institutions in Vietnam must comply with the principles specified in Article 2 of Circular 20/2023/TT-BGDDT, as follows:

(1) Determining job positions and the number of people working in public general education establishments is carried out according to the provisions of Article 3 of Decree 106/2020/ND-CP.

(2) Employment positions and the number of people working in public general education establishments must ensure:

- Sufficient number of people working according to the norms prescribed in Circular 20/2023/TT-BGDDT to carry out the teaching of all subjects and educational activities in the General Education Program issued by the Ministry of Education and Training and to perform shared professional work, support, and service work of public general education institutions;

- For job positions that do not have enough workload to be performed within the prescribed time of one employee, they should be arranged to perform part-time duties. For job positions that have not yet been staffed, labor contracts or part-time contracts are required. Persons assigned part-time jobs must be trained and fostered to meet the professional capacity of the part-time job position.

(3) The number of teachers in public schools includes teachers recruited as civil servants and teachers on labor contracts.

Public general education establishments are arranging a lower number of teachers than the maximum limit as prescribed in Circular 20/2023/TT-BGDDT (because the assigned staff is not enough according to the maximum quota or cannot be recruited) based on the maximum quota specified in Circular 20/2023/TT-BGDDT to determine the number of teachers signing labor contracts according to the provisions of Decree 111/2022/ND-CP.

(4) The number of people working according to the norms and job positions specified in Circular 20/2023/TT-BGDDT is determined according to the class size of each general education institution.

(5) For high schools with many levels:

- The number of vice principals is implemented according to the regulations on the number of deputy levels in Decree 120/2020/ND-CP;

- The number of teachers is implemented according to regulations in Circular 20/2023/TT-BGDDT for each educational level;

- List of job positions, quota of number of people working for job positions with specialized professional titles (except for teachers and teachers who are in charge of the Ho Chi Minh Young Pioneers Team and support the education of people with disabilities), shared professional positions, and support and service positions of high schools with many educational levels are implemented according to regulations for the highest educational level.

In particular, the number of classes or students as a basis for calculating the number of people working according to regulations for the highest educational level is the total number of classes or total number of students of all educational levels;

- Job positions supporting the education of people with disabilities for high schools with many levels of education with students with disabilities learning in integration: Schools with less than 20 students with disabilities learning integration will be assigned 01 person; Schools with 20 or more students with disabilities studying for integration will be assigned a maximum of 02 people;

- Each school arranges 01 teacher (elementary school teacher or middle school teacher) to be the general teacher in charge of the Ho Chi Minh Young Pioneers Team.

Circular 20/2023/TT-BGDDT takes effect on December 16, 2023.
