Regarding this issue, LawNet would like to answer as follows:
On November 29, 2023, the Ministry of Finance issued Decision 2609/QD-BTC amending the Regulations on raising salary levels ahead of schedule due to excellent achievements in performing tasks for civil servants and public employees at units under the Ministry.
According to Article 5 of the Regulations issued with Decision 2215/QD-BTC in 2021 (amended in Decision 2609/QD-BTC in 2023), principles for considering salary increases ahead of time due to excellent achievements for civil servants and public employees of the Ministry of Finance are as follows:
(1) Consideration and decision to raise the salary level ahead of schedule must ensure fairness, democracy, openness, and transparency, and encourage officials participating in the emulation movement to achieve many achievements, contributing to completing and exceeding the unit's political tasks.
(2) The consideration of a salary increase ahead of time is considered according to the following principles:
- Consider raising salary levels ahead of schedule for civil servants and public employees who meet all conditions and standards as prescribed in Article 2 of this Regulation; in which the first consideration shall be made for those who, during the period (6 years and 4 years) specified in Clause 1, Article 4 of this Regulation, do not commit any violations and must be handled with disciplinary measures.

- Consider in order of priority, the level of reward and achievement from the highest down until the end of the salary increase target before the prescribed deadline. In cases where many people have the same highest level of achievement and reward, consideration for salary increases ahead of time will be in the following order of priority:
+ Those who are close to the prescribed retirement age, if not considered at this time, will no longer have the opportunity to get a salary increase before the next deadline (except in the case that that person will have his or her salary upgraded ahead of time to retire as prescribed in Clause 2, Article 3 of Circular 08/2013/TT-BNV dated July 31, 2013 of the Ministry of Home Affairs).
+ People with more achievements at the same reward level (within a period of 6 years or 4 years specified in Clause 1, Article 4 of this regulation). In the event that there is a certificate of merit, priority will be given to the certificate of merit of the General Director level and equivalent before the certificate of merit of the Director of the Department and equivalent.
+ People who are wounded soldiers, sick soldiers, people receiving policies such as war invalids, people infected with toxic chemicals, people with disabilities;
+ People who do not hold leadership positions;
+ Ethnic minorities, female officers;
+ People with more years of work;
+ Those who have not received a salary increase before the deadline;
+ People whose scientific research and innovative initiatives have been applied in practice and brought about clear results;
+ People with unreasonable salary developments (disadvantaged); The level and nature of the job requirements are more complex and difficult;...
(3) In cases where officials, civil servants, and public employees are both subject to consideration for salary increases ahead of schedule due to excellent achievements in performing tasks and also subject to consideration for salary increases ahead of schedule when there is a retirement notice, officials, civil servants, and public employees can choose one of two salary increase regimes before the above deadline.
