In the course of its operations, SCIC is allowed to mobilize capital from domestic and international organizations and individuals to serve its business activities.
The mobilization of capital by SCIC shall be carried out according to the following principles:
- Based on the 5-year investment development strategy and plan, and the annual production and business plan of the enterprise;- The capital mobilization plan must ensure debt repayment capacity;- The person approving the capital mobilization plan shall be responsible for supervising and inspecting to ensure that the mobilized capital is used for the right purposes and effectively;- Mobilization of capital from domestic organizations and individuals must be carried out through a capital loan contract with the organization or individual in accordance with the law; in case of borrowing from the State's development investment credit capital, it shall comply with the provisions of the law on development investment credit and other relevant legal regulations;- Mobilization of capital from foreign organizations and individuals, borrowing or issuing bonds guaranteed by the Government of Vietnam shall comply with the legal provisions on public debt management and other relevant legal regulations;- Mobilization of capital in the form of corporate bond issuance shall comply with the legal regulations.
The SCIC Board of Members decides or delegates the General Director of SCIC to decide on the capital mobilization plan for each project with a mobilized amount not exceeding 25% of the equity recorded in the quarterly financial report or annual financial report of SCIC at the closest point in time to the capital mobilization but not exceeding the capital level of a group B project as prescribed by the Law on Public Investment.
Mobilization of capital for production and business purposes (including guarantees for subsidiary companies) must ensure that the total liabilities do not exceed three times the equity of SCIC recorded in the quarterly financial report or annual financial report of SCIC at the closest point in time to the capital mobilization.
