To implement the work regarding pardon in 2024, the Prime Minister of Vietnam issued Official Telegram 76/CD-TTg on August 07, 2024, providing instruction related to this matter.

On August 7, 2024, the Prime Minister of the Government of Vietnam issued Official Telegram 76/CD-TTg regarding the implementation of the work regarding pardon in Vietnam in 2024.

To strictly and effectively implement the work regarding pardon in Vietnam in 2024, to fulfill the humanitarian and leniency policies of the Communist Party and the State towards offenders, and to effectively implement the Resolutions, Directives, Programs, and Plans of the Central Government, the National Assembly, and the Government of Vietnam on crime prevention and control, the Prime Minister of the Government of Vietnam requests the following:

- The Ministry of Public Security should effectively perform its advisory function, act as standing member of the Pardon Advisory Council; it is directly responsible for directing the consideration of amnesty requests for inmates serving sentences at detention camps, temporary detention centers, and holding facilities managed by the Ministry of Public Security; to urge, guide, and inspect Ministries, sectors, and localities in implementing, promptly removing arising difficulties and obstacles, and in cases beyond their authority, report to the pardon Advisory Council for consideration.

- The Ministry of National Defense is directly responsible for closely directing the consideration of amnesty requests for inmates serving sentences at detention camps and temporary detention centers managed by the Ministry of National Defense.

- It is suggested that the Supreme People's Court directly directs, guides People's Courts, and Military Courts at all levels to take the lead in considering amnesty requests for those who are temporarily postponed or suspended from serving prison sentences.

- The Ministry of Information and Communications directs news agencies and press to fully report the content of documents regarding the 2024 amnesty so that citizens and inmates clearly understand the conditions, standards, procedures, and amnesty processes, enabling them to protect their legal rights and interests, and monitor the activities of functional agencies to avoid confusion and mistakes; at the same time, contributing to raising awareness and responsibility of all levels, sectors, social organizations, and the public in eliminating prejudice against those granted amnesty and creating favorable conditions for their reintegration into the community.

- Ministries, sectors, and agencies mentioned in the pardon Advisory Council's Guidelines need to have specific plans for the implementation of their assigned tasks; organize dissemination, thoroughly understand, and ensure the implementation of the amnesty work in a unified, safe, public, and transparent manner following strict procedures, complying with the correct subjects and legal conditions, safeguarding the legal rights and interests of inmates, and absolutely preventing negative occurrences and errors.

- The Chairpersons of the People's Committees of provinces and centrally-run cities direct sectors, People's Committees at all levels to cooperate with Fatherland Front and mass organizations to seriously implement Decision 758/2024/QD-CTN on the 2024 amnesty by the President and Guideline 88/HD-HDTVDX 2024 by the pardon Advisory Council.

To be specific:

- Direct the Departments of Information and Communications to closely coordinate with the provincial, city Party Propaganda Committees, and local press agencies to widely publicize the amnesty work on mass media.

- Direct the Departments: of Justice, Labor - Invalids and Social Affairs, Health, and People's Committees at all levels within their functions and tasks to provide sufficient information, documents, certificates, confirmations, and other necessary documents related to those proposed for amnesty.

- Direct local authorities to cooperate with Fatherland Front, economic organizations, mass organizations, and social organizations in the locality to actively and effectively implement Decree 49/2020/ND-CP detailing the implementation of the Law on Execution of Criminal Judgments on community reintegration.

Continue to follow up, manage, educate, support, provide vocational training, and create jobs for those granted amnesty to return to the community, to eliminate prejudice, engage in lawful labor, and reduce recidivism and legal violations.

For those granted amnesty who have special difficulties, mobilize sectors, mass organizations, and socio-economic organizations to assist them in securing capital for livelihood, stabilizing life, and integrating into the community.

- Direct provincial police chiefs to cooperate with local departments, sectors, mass organizations, and social organizations to effectively manage, educate, and assist those granted amnesty; closely monitor the situation and movements of those granted amnesty who return to reside in the locality, preventing them from affecting national security and public order and safety, and promptly and severely handle individuals who repeat offenses and violate the law.
