Regarding this issue, LawNet would like to answer as follows:

On February 15, 2024, the Prime Minister of Vietnam issued Directive 06/CT-TTg, urging the implementation of key tasks after the Lunar New Year holiday of the Dragon 2024.

The Prime Minister requests relevant ministries, agencies, localities, organizations, and individuals, according to their assigned functions, tasks, and delegated powers, to immediately focus on handling work after the Lunar New Year holiday of the Year of the Snake without causing delays that may affect production, business activities, and socio-economic activities, especially regarding tasks that were postponed due to the holiday. They are also involved in urgently, seriously, consistently, and effectively implementing the tasks and solutions assigned by the Government and the Prime Minister, especially as stated in Resolution 01/NQ-CP and Resolution 02/NQ-CP dated January 5, 2024 , and Resolution 20/NQ-CP dated February 5, 2024, of the Government at the Regular Government Meeting in January 2024;

Focus on promoting production and business, creating jobs and livelihoods for people, and effectively implementing social security work to ensure comprehensive, multi-layered, modern, inclusive, and sustainable; At the same time, focus on immediately implementing the following key tasks:

- Ministers, Heads of ministerial-level agencies, Heads of Government agencies, Chairmen of People's Committees of provinces and centrally-run cities according to their assigned functions, tasks and powers:

+ Review and identify key tasks each month and quarter to focus on direction, administration, timely and effective policy responses, and complete solutions associated with strengthening inspection and urging, especially for content and issues that are still complicated, long-standing, and arising problems...

+ Continue to closely monitor the world and domestic situation, especially newly arising issues and policy adjustments of countries, to promptly advise the Government and the Prime Minister on key solutions to maintain macroeconomic stability, promote growth, control inflation, and ensure major balances of the economy. Actively monitor developments closely to promptly have solutions to balance supply and demand and stabilize market prices after the Lunar New Year, especially goods and services with increased demand, such as food, transportation, tourism at entertainment spots, sightseeing, festivals, etc.

+ Focus on perfecting institutions, mechanisms, and policies to mobilize resources for national development. Accelerate the progress of developing, submitting, and promulgating documents detailing and guiding the implementation of Laws and Resolutions passed at the 6th and 5th Extraordinary Sessions; at the same time, focus on building and ensuring the progress and quality of projects under the 2024 Law and Ordinance Development Program, and carefully prepare the contents to serve the 7th session of the 15th National Assembly.

+ Drastically and effectively deploy solutions to promote disbursement of public investment capital right from the first days and months of 2024; consider this a key political task to create an "accelerating" driving force for socio-economic recovery and development associated with quality assurance, combating negativity, corruption, and waste. Ministries, branches, and localities urgently allocate in detail 100% of the public investment capital from the state budget in 2024 assigned by the Prime Minister, ensuring compliance with the provisions of the public investment law and resolutions of the Government.

Ministries, agencies, and localities synchronously deploy solutions, drastically direct the acceleration of progress, completion of investment procedures, construction progress, and capital disbursement of projects right from the beginning of the year. Implement the disbursement status reporting regime according to the regulations of the Ministry of Planning and Investment, the Ministry of Finance, and promptly handle it according to authority and report difficulties and problems to competent authorities during the implementation process.

+ Focus on promoting the construction progress of important national transport infrastructure projects such as component projects of the Eastern North-South Expressway, Dong Dang Expressway (Lang Son) - Tra Linh (Cao Bang), Huu Nghi - Chi Lang (Lang Son), Hoa Binh - Moc Chau (Son La), Ninh Binh - Nam Dinh - Thai Binh - Hai Phong, Belt project 4 of Hanoi capital, Belt 3 of Ho Chi Minh City, Khanh Hoa - Buon Ma Thuot, Chau Doc - Can Tho - Soc Trang, Bien Hoa - Vung Tau, Tuyen Quang - Ha Giang, Port Long Thanh International Airport, Terminal T3 - Tan Son Nhat International Airport; 500 Kv power transmission line, circuit 3 from Quang Trach (Quang Binh) to Pho Noi (Hung Yen)... Accelerate the progress of investment preparation and investment decisions; establish, appraise, and approve implementation designs after the basic design; and select contractors to soon start construction on projects assigned to the managing agency, especially projects expected to allocate sources to increase revenue under the Central Policy for 2023 and 2024.

+ Drastically remove difficulties and obstacles for people and businesses to promote strong development of production and business activities in all fields; substantively reform administrative procedures; and reduce business regulations. Focus on promoting the implementation of the Scheme to develop the application of population data, identification, and electronic authentication to serve national digital transformation in the period 2022–2025, with a vision to 2030 (Scheme 06) according to the direction of the Prime Minister in Directive No. 04/CT-TTg dated February 11, 2024.

+ Accelerate the progress of preparing the 5-year land use plan 2021-2025 at the provincial level and send it to the Ministry of Natural Resources and Environment for appraisal; Urgently complete and submit to competent authorities for approval to ensure timeliness, feasibility, consistency, and synchronization in accordance with the provisions of land law and planning law; organize a land inventory in 2024 according to legal regulations.

+ Timely reward or propose appropriate rewards to competent authorities to recognize and encourage organizations, individuals, and functional forces with outstanding achievements, excellence, and spirit of serving the people during the Lunar New Year Giap Thin.

- Chairman of People's Committees of provinces and centrally run cities with expressways passing through or are the managing agencies of projects assigned by the Government are responsible for:

+ Add human resources and drastically direct agencies and units to speed up site clearance work according to the schedule requested by the Government and the Prime Minister and focus on building resettlement areas to stabilize people's lives; Coordinate with Vietnam Electricity Group to complete the plan and organize the relocation of high voltage power lines. For localities where expressway projects are still slow, complete handover of the entire site is expected in the first quarter of 2024.

+ Coordinate with investors and construction contractors to complete mineral exploitation procedures for common construction material mines according to the specific mechanism specified in the Resolution of the National Assembly and the Government, meeting the construction schedule; Participate with investors and contractors to work with and negotiate with owners on land transfer and rental prices to ensure compliance with the compensation price level prescribed by the state. It is absolutely strictly forbidden to allow speculation, price increases, or "price pressure" to occur. In case any individual or organization is found to be in violation, the authorities will strictly handle it according to the law; Use sanctions to handle cases of intentionally raising prices, "suppressing prices,"  and speculating on land in mining areas.

+ Localities with sources of foundation materials for highway projects shall direct relevant departments and branches to coordinate closely with investors and contractors to implement procedures for handing over mines to mining contractors to ensure reserves and mining capacity meet requirements; Maximum support for investors and contractors to access and survey sand mines (river sand, sea sand) in the area.

+ For the component project of the Can Tho-Ca Mau section of the Eastern North-South Expressway Project for the period 2021-2025, the People's Committees of the provinces are required to: An Giang, Dong Thap, and Vinh Long urgently issue "Confirmation" according to the instructions of the Ministry of Natural Resources and Environment for 05 mines (An Giang province) where contractors have submitted documents to complete procedures for fulfilling tax and fee obligations and be able to exploit before February 20, 2024;

Support contractors to exploit the maximum operating capacity of equipment, vehicles, and mining time of day to ensure mining output, at the same time, based on the actual exploitation situation of the granted mines, review the approved environmental impact assessment content to consider and have a plan to increase the exploitation capacity of the granted mines (if eligible);

Reviewing currently exploited mines and new mine areas in the area (especially An Giang and Vinh Long provinces), prioritizing mines to renew and increase capacity to supply for the project and assigning new mines to contractors to implement mining procedures, ensuring enough capacity to provide enough sand to the construction site as assigned by the Prime Minister by June 30, 2024, and directing agencies and units to minimize the time to carry out procedures so that they can be exploited before March 20, 2024.

+ People's Committees of Tra Vinh and Soc Trang provinces direct relevant departments and branches to coordinate closely with the Ministry of Natural Resources and Environment, investors, and contractors to implement procedures for handing over sea sand mines to contractors for exploitation according to the specific mechanism stated in the Resolutions of the National Assembly and the Government.
