Press Release No. 5 Fourth Session, 15th National Assembly

Tuesday, October 25, 2022, the 4th session of the 15th National Assembly commenced its 5th working day at the National Assembly House, the Capital of Hanoi, under the chairmanship of National Assembly Chairman Vuong Dinh Hue.

Morning

Under the chairmanship of Vice Chairman of the National Assembly Nguyen Khac Dinh, the National Assembly heard: (1) Minister of Information and Communications Nguyen Manh Hung, authorized by the Prime Minister of Vietnam, present the Statement on the Electronic Transactions Law (amended) project; (2) Chairman of the National Assembly's Committee for Science, Technology, and Environment Le Quang Huy present the Appraisal Report on the Electronic Transactions Law (amended) project; (3) Chairman of the National Assembly's Committee for Legal Affairs Hoang Thanh Tung present the Report on the explanation, acceptance, and adjustment to the draft Law on Inspection (amended). Following that, the National Assembly discussed in the hall some differing opinions on the draft Law on Inspection (amended).

During the discussion, 23 delegates spoke, and 1 delegate debated. Most delegates agreed with many points in the Report on the explanation, acceptance, and adjustment to the draft Law on Inspection (amended). Additionally, delegates focused on giving opinions on the contents: the structure of the draft Law; principles of inspection operations; the system structure, functions, duties, and powers of inspection agencies; the establishment of departmental inspections, specialized inspections, inspections under the Ministry, inspections under the Directorate of the Ministry, inspections under agencies of the Government of Vietnam; responsibilities and powers of heads of state management agencies, those who make inspection decisions, heads of inspection teams; the issuance of inspection plans, inspection decisions, inspection conclusions; authority, order, procedures for resolving complaints during inspections; responsibilities of heads of state agencies in inspection and examination work; rights of the inspection subjects; handling violations during inspections; complaints and petitions of related agencies, organizations, individuals; recovery of assets appropriated, illegally used, or lost due to illegal actions; coordination responsibilities in inspection, state audit, and investigation activities; handling overlaps and duplications in inspection activities; operational expenses of inspection agencies; policies for Inspectors. Furthermore, some delegates proposed supplementing regulations on the establishment of the specialized social insurance inspection agency into the draft Law.

At the end of the discussion, Chief Government Inspector Doan Hong Phong, on behalf of the presenting agency and the presiding appraisal agency, explained and clarified some issues raised by the National Assembly delegates.

Afternoon

Under the chairmanship of Vice Chairman of the National Assembly Nguyen Duc Hai, the National Assembly heard: (1) Minister of Industry and Trade Nguyen Hong Dien, authorized by the Prime Minister of Vietnam, present the Statement on the Law on Protection of Consumer Rights (amended) project; (2) Chairman of the National Assembly's Committee for Science, Technology, and Environment Le Quang Huy present the Appraisal Report on the Law on Protection of Consumer Rights (amended) project; (3) Chairman of the National Assembly's Economic Committee Vu Hong Thanh present the Report on the explanation, acceptance, and adjustment to the draft Petroleum Law (amended). Following that, the National Assembly discussed in the hall some differing opinions on the draft Petroleum Law (amended).

During the discussion, 13 delegates spoke, with most agreeing with many points in the draft Petroleum Law (amended). Additionally, the delegates focused on giving opinions on the contents: the title, structure, scope of regulation, and subjects of application of the draft Law; the interpretation of terms; prohibited acts; forms of selecting contractors to sign petroleum contracts; the exercise of the right to participate and the priority right to buy the participation rights in petroleum contracts; conditions for bidding to select contractors to sign petroleum contracts; criteria and methods for evaluating the selection of contractors; obligations of contractors; state management responsibilities, principles, conditions, and organization of basic investigations on petroleum and petroleum activities; policies for exploiting resources at exhausted petroleum mines; approval of petroleum contracts; types of petroleum contracts; cost settlement for petroleum activities under petroleum contracts; functions, rights, and obligations of the Vietnam Oil and Gas Group; handling of costs for the Vietnam Oil and Gas Group; preferential policies in petroleum activities; environmental protection in petroleum exploration and exploitation activities; development projects of petroleum mines on land; development projects of petroleum mines with integrated facilities and equipment on land and at sea; prevention and control of incidents in petroleum exploration and exploitation; amending and supplementing several articles and clauses of the Corporate Income Tax Law and the Resource Tax Law related to petroleum activities.

At the end of the discussion, Minister of Industry and Trade Nguyen Hong Dien, on behalf of the presenting agency and the presiding appraisal agency, explained and clarified some issues raised by the National Assembly delegates.

Wednesday, October 26, 2022:Morning:The National Assembly will discuss in groups: The draft Resolution on pilot granting of auction rights to choose car license plates; The draft Resolution on piloting certain specific mechanisms and policies for the development of Buon Ma Thuot city, Dak Lak province;Afternoon(The session will be broadcast live on Vietnam National Assembly Television): The National Assembly will hear: The Statement and Appraisal Report on the Civil Defense Law project; the Report on the explanation, acceptance, and adjustment to the draft Domestic Violence Prevention and Control Law (amended). Following that, the National Assembly will discuss in the hall some differing opinions on the draft Domestic Violence Prevention and Control Law (amended)./.
