Tuesday, November 8, 2022, the 4th session of the 15th National Assembly commenced its 16th working day at the National Assembly House, Hanoi Capital, under the chairmanship of National Assembly Chairman Vuong Dinh Hue.

The National Assembly convened a plenary session at the Assembly Hall under the chairmanship of Deputy Chairman of the National Assembly Nguyen Khac Dinh to listen to: (1) Minister of Public Security To Lam, authorized by the Prime Minister of the Government of Vietnam, presenting the Report on crime prevention and legal violations in 2022; (2) Chief Procurator of the Supreme People's Procuracy Le Minh Tri presenting the 2022 Annual Report of the Chief Procurator of the Supreme People's Procuracy; (3) Chief Justice of the Supreme People's Court Nguyen Hoa Binh presenting the 2022 Annual Report of the Chief Justice of the Supreme People's Court; (4) Minister of Justice Le Thanh Long, authorized by the Prime Minister of the Government of Vietnam, presenting the Report on the enforcement of judgments in 2022; (5) Chairwoman of the Judiciary Committee of the National Assembly Le Thi Nga presenting the Verification Report on the reports of the Chief Justice of the Supreme People's Court, Chief Procurator of the Supreme People's Procuracy; crime prevention and legal violations; and the enforcement of judgments in 2022; (6) Inspector General of the Government of Vietnam Doan Hong Phong, authorized by the Prime Minister of the Government of Vietnam, presenting the Report on anti-corruption work in 2022; (7) Chairwoman of the Judiciary Committee of the National Assembly Le Thi Nga presenting the Verification Report on the Report on anti-corruption work in 2022.

The National Assembly then spent the whole day discussing the work reports of the Chief Justice of the Supreme People's Court, Chief Procurator of the Supreme People's Procuracy; crime prevention and legal violations; enforcement of judgments; anti-corruption work in 2022; and the Draft Resolution of the National Assembly on applying statutes of limitations for disciplining officials and public employees; the implementation of Law on Exit and Entry of Vietnamese Citizens related to the "place of birth" information on passports. Minister of Public Security To Lam, Chief Justice of the Supreme People's Court Nguyen Hoa Binh, Chief Procurator of the Supreme People's Procuracy Le Minh Tri, and Minister of Justice Le Thanh Long made explanatory statements, clarifying several issues raised by National Assembly deputies.

During the discussion, there were 33 delegates who spoke, and 1 delegate engaged in debate. Most of the delegates agreed with the content of the reports; agreed to use the data collection period for reports from January 1 to December 31 annually and present them to the National Assembly at the mid-year session; besides, the delegates focused on discussing the following contents:

1. On crime prevention and legal violations: The situation of legal violations and crimes in 2022 (developments, nature, and new characteristics of crimes and legal violations compared to 2021, prominent issues of crimes and legal violations that attract public and voter interest, and their causes); forecasts on the crime and legal violation situation in the future; existing shortcomings in state management across various areas of socio-economic life leading to crimes and legal violations; remedial solutions; the implementation of laws in crime handling across areas: public order, traffic safety, fire prevention; prevention and combat against corruption crimes, murder, human trafficking, child abuse, drug crimes, cybercrimes... Delegates suggested the Government of Vietnam direct ministries and sectors to review and clarify the inadequacies in state management to have solutions to limit violations and crimes in some prominent areas in 2022; direct and enhance the effectiveness of crime investigation and handling; strengthen propaganda, popularization, and legal education; improve the rate of resolution of crime reports and denunciations.

2. On the report by the Chief Procurator of the Supreme People's Procuracy: The exercise of the right to prosecute, supervise investigation, and supervise the trial of criminal cases; the quality of the prosecution's arguments in court; the supervision of civil, administrative cases; the enforcement of judgments; resolution of petitions for cassation and reopening; achievements, limitations, causes, and remedial solutions. Some delegates suggested increasing the effectiveness of the investigative agencies of the Supreme People's Procuracy, ensuring the rate of resolution of crime reports and denunciations, and petitions for prosecution meet the targets set by the National Assembly; and including the activities of the military procuracy in the report.

3. On the report by the Chief Justice of the Supreme People's Court: The settlement and adjudication of criminal, administrative cases, and civil cases; the supervision of cassation, reopening judgments; handling administrative measures by the people's courts at different levels; achievements, limitations, causes, and remedial solutions; results of organizing online trials under Resolution No. 33/2021/QH15 of the National Assembly. Some delegates suggested the Chief Justice of the Supreme People's Court continue to direct the handling of petitions for cassation, reopening, and prioritize resolving petitions from previous years that are nearing the deadline for appeal; enhance the practical summary work of court trials, thereby issuing guidelines for the uniform application of laws in trials.

4. On the enforcement of judgments: The enforcement of civil judgments (guidelines for executing key cases, economic, and corruption cases; solutions to handle long-overdue civil cases); enforcement of criminal judgments (management of detention, execution of death sentences; situation of prisoners violating regulations in detention facilities); enforcement of administrative judgments (management, monitoring, urging enforcement of administrative judgments and solutions to quickly enforce long-overdue judgments). Some delegates suggested the Government of Vietnam needs to have solutions to strengthen the organization, staffing, facilities, and equipment for enforcement agencies; focus on measures to recover assets in economic and corruption cases related to credit, banking, and securities.

5. On anti-corruption work: The current state of corruption; advantages, limitations, and causes in implementing anti-corruption preventive measures as prescribed by law; detection and handling of corruption, recovery of corrupt assets (achievements; responsibilities of ministries, central and local authorities, agencies, organizations, units; limitations, difficulties, inadequacies, causes and solutions); feasibility and effectiveness of solutions to overcome limitations and inadequacies in anti-corruption work in 2023 and subsequent years. Some delegates suggested that the National Assembly, Government of Vietnam, Supreme People's Court, Supreme People's Procuracy, and State Audit continue to build and complete a synchronized legal system; strictly enforce discipline, uphold responsibility, especially of leaders in law-making work; strengthen inspections, checks, and audits, focusing on bidding, auctions, land management and use, securities, tax management...; effectively prevent harassment, negativity, “petty corruption,” causing trouble for people and businesses; promote investigation, prosecution, trial, and enforcement; further improve the effectiveness of recovery of corrupt assets.

6. On the Draft Resolution of the National Assembly on applying statutes of limitations for disciplining officials and public employees: Delegates agreed with the statutes of limitations for disciplining officials and public employees as stipulated in the Draft Resolution of the National Assembly.

7. On the implementation of the Law on Exit and Entry of Vietnamese Citizens related to the "place of birth" information on passports: Delegates agreed on the necessity to include the "place of birth" information on passports to facilitate citizens in visa application, entry, residence, and related procedures in countries requiring the place of birth information on passports, especially the Czech Republic and other Schengen countries.
