Preferential Regime for Revolutionaries Active Before January 01, 1945

Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution (Amended 2012) issued by the Standing Committee of the National Assembly on July 16, 2012. Notably, the Ordinance includes amended regulations on preferential policies for individuals who participated in revolutionary activities before January 1, 1945.

To be specific, according to Clause 4, Article 1 of the Amended Ordinance on Preferential Treatment of People with Meritorious Services to the Revolution 2012, which amends and supplements Article 9 of the Ordinance on Preferential Treatment of People with Meritorious Services to the Revolution 2005, the regulations on preferential policies for revolutionary activists before January 01, 1945 are as follows:

- Revolutionary activists before January 01, 1945 are those recognized by competent authorities and organizations as having participated in revolutionary organizations before January 01, 1945.

- Preferential policies for revolutionary activists before January 01, 1945 include:

- Monthly allowance, monthly subsidy;- Health insurance; annual convalescence for health recovery; provision of necessary assistive devices and orthopedic tools;- Financial support for purchasing Nhan Dan newspaper; opportunities to participate in cultural and spiritual activities suitable to them;- State support for improving housing conditions based on their contributions and personal circumstances.

- Preferential policies when a revolutionary activist before January 01, 1945 passes away include:

- If a revolutionary activist before January 01, 1945 who is receiving the preferential policies specified in Clause 2, Article 9 of the Ordinance on Preferential Treatment of People with Meritorious Services to the Revolution 2005 dies, the person organizing the funeral will receive funeral expenses, and relatives will receive a subsidy;- If a revolutionary activist before January 01, 1945 passed away before receiving the preferential policies specified in Clause 2 of this Article, their relatives will receive a one-time allowance;- Biological parents; spouse; children under 18 years old or 18 years old and above if continuing education or suffering from severe disabilities, and extremely severe disabilities will receive monthly pension benefits.

If the biological parents, spouse live alone without support, or the children are orphans under 18 years old or 18 years old and above if continuing education or suffering from severe disabilities, extremely severe disabilities will receive additional monthly nurturing pension benefits;

- Biological parents; spouse; children from 6 years old to under 18 years old or 18 years old and above if continuing education or suffering from severe disabilities, extremely severe disabilities will be provided with health insurance by the State.

The children of revolutionary activists before January 01, 1945 will enjoy preferential and support policies as stipulated in Clause 5, Article 4 of the Ordinance on Preferential Treatment of People with Meritorious Services to the Revolution 2005.

The Government of Vietnam stipulates specific conditions and standards for recognizing revolutionary activists before January 01, 1945.
