Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution (Amended 2012)This Ordinance amends and supplements certain articles of the Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution 2005, which was promulgated on July 16, 2005.This Ordinance amends and supplements regulations concerning preferential policies for revolution participants affected by chemical toxins.
To be specific, according to Clause 18, Article 1 of the Ordinance on Preferential Treatment for Revolutionary Contributors (Amended) 2012, amending and supplementing Article 26 of the Ordinance on Preferential Treatment for Revolutionary Contributors 2005, these regulations are as follows:
- A person engaged in resistance activities affected by toxic chemicals is someone recognized by competent authorities as having participated in work, combat, or served in combat from August 1961 to April 30, 1975, in areas where the U.S. military used toxic chemicals, resulting in one of the following cases:- Suffering from a disease that reduces labor capability by 21% or more;- Infertility;- Giving birth to deformed or disabled children.
- The monthly allowance regime for persons engaged in resistance activities affected by toxic chemicals are as follows:- Those falling under the provisions of point a, clause 1, Article 26 of the Ordinance on Preferential Treatment for Revolutionary Contributors 2005 shall receive a monthly allowance based on the degree of labor incapacity, ranging from 21% to 40%, from 41% to 60%, from 61% to 80%, and 81% or more.- Those falling under the provisions of point b or point c, clause 1, Article 26 of the Ordinance on Preferential Treatment for Revolutionary Contributors 2005 who do not suffer from diseases specified in point a, clause 1, Article 26, or if they do suffer from such diseases with a labor incapacity level below 61% shall receive a monthly allowance as if they had a labor incapacity level from 41% to 60%. In cases of labor incapacity from 61% or more, they shall receive a monthly allowance corresponding to the level of labor incapacity from 61% to 80%, from 81% or more as stipulated in point a, clause 2, Article 26 of the Ordinance on Preferential Treatment for Revolutionary Contributors 2005.
- Other preferential policies for persons engaged in resistance activities affected by toxic chemicals include:- Health insurance; provision of assistive devices, orthopedic instruments based on each person's condition and the State's capability;- Health restoration every two years; in cases where labor incapacity is from 81% or more, annual health restoration shall be provided;- Persons with a labor incapacity from 81% or more shall receive a monthly allowance; if they live with their family, they shall be granted a caregiver allowance. The caregiver looking after a person engaged in resistance activities affected by toxic chemicals as specified in this point shall be provided with health insurance by the State;- Priority in land allocation or leasing, water surface, sea surface, preferential loans for production, tax exemption or reduction as per law provisions, and housing support as stipulated in clause 4, Article 4 of the Ordinance on Preferential Treatment for Revolutionary Contributors 2005;- When a person engaged in resistance activities affected by toxic chemicals dies, the funeral organizer shall receive funeral expenses, and the next of kin shall receive a death allowance.
- A person engaged in resistance activities affected by toxic chemicals with a labor incapacity from 61% or more who dies, the next of kin shall receive a survivorship pension as for the next of kin of war invalids.
- Those eligible for recognition and preferential treatment as stipulated in Articles 26 and 24 of the Ordinance on Preferential Treatment for Revolutionary Contributors 2005 shall receive monthly allowances as follows:- War invalids suffering from an additional disease as specified in point a, clause 1, Article 26 of the Ordinance on Preferential Treatment for Revolutionary Contributors 2005 due to toxic chemicals shall undergo a combined examination to receive a monthly allowance corresponding to the level of labor incapacity;- War invalids falling under the provisions of point b or point c, clause 1, Article 26 of the Ordinance on Preferential Treatment for Revolutionary Contributors 2005 shall receive both the monthly allowance for war invalids and the monthly allowance for those engaged in resistance activities affected by toxic chemicals with a labor incapacity level from 41% to 60%;- War invalids suffering from an additional disease as specified in point a, clause 1, Article 26 of the Ordinance on Preferential Treatment for Revolutionary Contributors 2005 due to toxic chemicals and falling under the provisions of point b or point c, clause 1, Article 26 of the Ordinance on Preferential Treatment for Revolutionary Contributors 2005 shall choose to receive the monthly allowance policies as specified in point a or point b, clause 5, Article 26 of the Ordinance on Preferential Treatment for Revolutionary Contributors 2005.
