Recently, the Ministry of Public Security has submitted the Draft Law on ensuring road traffic order and safety to the National Assembly of Vietnam for consideration. This Draft Law has stipulated powers of traffic police in patrolling and controlling.
According to the Draft Law on ensuring road traffic order and safety of Vietnam, powers of traffic police in patrolling, controlling, preventing, handling violations of road traffic order and safety, fighting against crime and other law violations on road traffic routes are as follows:
1. Stop vehicles participating in road traffic for control in the following cases:
- Through the use of professional technical means and equipment, detecting administrative violations of road traffic order and safety and other law violations;
- In order to immediately prevent violations of the law on road traffic order and safety and other law violations, to which if is not stopped, will risk causing traffic insecurity and danger to society;
- Carry out orders and plans of competent authorities on stopping road vehicles to control and ensure security, order and traffic safety, fight against crime and other law violations;
- Reporting, recommendations and denunciations of organizations and individuals about illegal acts of people and vehicles participating in road traffic;
- The stopping of vehicles participating in road traffic must ensure safety, not obstruct or cause traffic jams;
2. Be entitled to control land vehicles, papers of road vehicles, papers of road vehicle drivers, identification papers of the person on the road vehicle under control according to the provisions of law; control the implementation of the provisions of the law on road transport activities;
3. Handle violations of road traffic order and safety, social order and other violations in accordance with law;
4. Request agencies, organizations and individuals to coordinate and assist in the settlement of accidents, traffic jams, obstructions or other cases causing disorder and road traffic safety;
5. Be equipped, installed and use means of transport; professional technical means and equipment; weapons and supporting tools as prescribed by law;
6. Be allowed to temporarily suspend travel in certain sections of the road, redistribute traffic, redistribute routes and places to stop and park vehicles when there is a situation of congestion, road traffic accident or when there are other necessary requirements on ensuring security, order and social safety;
7. Exercise other powers of the People's Public Security force in accordance with law.
