Recently, the Government of Vietnam promulgated Decree 165/2017/ND-CP on the regulations for the management and use of property at the Communist Party of Vietnam's agencies.
Power to approve the scheme on property use for business at the Communist Party of Vietnam's public service providers (Illustrative image)
As stipulated in Article 41 of Decree 165/2017/ND-CP, the power to approve the scheme on property use for business or leasing at the Communist Party of Vietnam's public service providers is specified as follows:
- The Chief of the Office of Central Committee of the Communist Party of Vietnam approves schemes concerning property at the Communist Party of Vietnam's public service providers at the central level which are operational facilities; other properties with an initial value of 500 million VND or more per unit;
- The Standing Committee of the Provincial CPV Committee decides or delegates power to approve schemes concerning property at the Communist Party of Vietnam's public service providers within its management scope which are operational facilities; other properties with an initial value of 500 million VND or more per unit;
- The Management Board or the head of the public service provider of the Communist Party approves schemes concerning property not specified in points a and b of this clause.
Furthermore, this Decree also stipulates the power to approve the scheme on property use for joint venture and association at the Communist Party of Vietnam's public service providers:
- The Chief of the Office of Central Committee of the Communist Party of Vietnam approves schemes concerning property at the Communist Party of Vietnam's public service providers at the central level which are operational facilities; other properties with an initial value of 500 million VND or more per unit; in cases where the property are assigned by the State to the public service provider for management, utilization, or invested construction and procurement from the state budget, the approval is made after obtaining written opinions from the Ministry of Finance;
- The Standing Committee of the Provincial CPV Committee decides or delegates power to approve schemes concerning property at the Communist Party of Vietnam's public service providers within its management scope which are operational facilities; other properties with an initial value of 500 million VND or more per unit; in cases where the property are assigned by the State to the public service provider for management, utilization, or invested construction and procurement from the state budget, the approval is made after obtaining written opinions from the Standing Committee of the Provincial People’s Council;
- The Management Board or the head of the public service provider approves schemes concerning property not specified above.
