Regarding this matter, LawNet would like to answer as follows:

On May 3, 2024, the Minister of Finance issued Circular 27/2024/TT-BTC on the list and time for periodic reassignment of officials and public employees directly involved in and responsible for work in the financial sector at local authorities.

Positions subject to periodic reassignment in the financial sector in Vietnam as of June 17, 2024

Starting on June 17, 2024, the following positions in the financial sector must undergo position reassignments:

- Budget allocation;

- Accounting, Chief Accountant;

- Public procurement;

- Appraisal, inspection, and settlement of funds as regulated by the Law on State Budget;

- Appraisal, valuation in auctions.

Time for periodic reassignment under the law in Vietnam 

According to Article 6 of Circular 27/2024/TT-BTC, the time for periodic reassignment is as follows:

- The time for the periodic reassignment of officials and public employees directly involved in and responsible for work as specified in Article 5 of Circular 27/2024/TT-BTC is from 2 to 5 years, according to regulations (excluding the probationary period of officials and public employees).

- The starting point for calculating the time for position reassignment is the time of the decision on rotation, assignment, and task allocation by the competent authority in accordance with the hierarchical management of officials.

Methods of implementing periodic reassignment in Vietnam

- The methods of implementing periodic reassignment are specified in Article 3 of Circular 27/2024/TT-BTC as follows:

The reassignment of positions is a content of personnel work under the leadership of the Party, directly by Party organizations at all levels; ensuring the principles of centralized democracy, emphasizing the collective responsibility of leadership and the head of the agency.

Annually, the CPV committee at each level and the head of the agency must issue and disclose the plan for periodic reassignment; the plan for periodic reassignment must clearly state the purpose, requirements, specific cases that need to be reassignmentred, the time for implementation, the rights, obligations of those who need to be reassignmentred, and the measures for implementation.

The review and development of the plan for periodic reassignment are carried out in the first quarter of each year.

Position reassignments within the same professional field, expertise from one department to another within the agency; between different sectors, localities assigned for monitoring, responsibility, and management, or between agencies within the scope of local authorities' management.

For agencies that have only one position in the list of positions subject to periodic reassignment, and this position has different professional and expertise requirements compared to the remaining positions of that agency, the reassignment will be planned by the head of the higher-level agency.

Note: Cases of delayed reassignment has not yet been implemented

Cases of delayed reassignment shall be carried out in accordance with the regulations in Article 38 of Decree 59/2019/ND-CP, specifically:

- Individuals who are under consideration or facing disciplinary action.

- Individuals who are being inspected, verified, audited, investigated, prosecuted, or tried.

- Individuals undergoing treatment for serious illnesses confirmed by competent medical authorities; individuals attending centralized training for 12 months or more, individuals who are seconded.

- Pregnant women or those breastfeeding children under 36 months old; men who are raising children under 36 months old due to the loss of their wife or in other objective circumstances.
