On June 26, 2013, the Ministry of National Defense issued Circular 79/2013/TT-BQP regulating the functions, duties, powers, organizational structure, and work relations of the legal departments and legal officers in the Military.

Article 3 of Circular 79/2013/TT-BQP stipulates the specific positions and functions of legal departments and legal officers in the Military in Vietnam as follows:
1. Position
- The Legal Department of the Ministry of National Defense is an agency under the Ministry of National Defense, the leading professional agency in legal affairs in the Army, under the leadership, direction, and command in all aspects of the Central Military Commission, the Minister of National Defense regarding legal work; under the leadership and direction of the Party Committee of the Office of the Ministry of National Defense and the Chief of the Office of the Ministry of National Defense regarding Party work, political work, and military administration.
- The legal organization and legal officers at agencies and units are specialized professional officers in legal affairs, under the leadership, direction, and command of the Party Committee and commanders of agencies and units; under the leadership and direction of the Party Committee and commanders of the office (general staff agency or administrative agency) at the same level regarding Party work, political work, and military administration.
2. Function
- The Legal Department functions as an advisor to assist the Minister of National Defense in state management through law in the field of military and defense as prescribed by law; organizes and manages the work of drafting and promulgating legislative documents; appraises, reviews, systematizes, inspects, and handles legislative documents; codifies the legislative system; unifies legislative documents; controls administrative procedures; disseminates and educates law; inspects and monitors the enforcement of the law; manages the enforcement of administrative violation handling; manages state compensation work; implements laws on international treaties, international agreements; researches and summarizes legal work aspects under the state management authority of the Ministry of National Defense.
- The legal organization (assistants, legal officers) at agencies and units functions (responsibilities) as advisors to assist commanders of agencies and units in state management through law in the assigned sector and field; presides or coordinates in organizing the management of drafting legislative documents; drafts and promulgates internal regulations and administrative documents; appraises, reviews, systematizes, inspects, and handles legislative documents; unifies legislative documents; disseminates, educates about the law, and inspects the implementation of laws according to regulations in Vietnam.
