The National Assembly of Vietnam passed the Law on Organization of the Government of Vietnam 2025 on February 18, 2025.
According to Article 16 of the Law on Organization of the Government of Vietnam 2025, the position and functions of Ministers and Heads of equivalent agencies are stipulated as follows:
Ministers and Heads of equivalent agencies are members of the Government of Vietnam and are the heads of ministries, equivalent agencies, directing the work of ministries and such agencies; they are responsible for state management of one or several sectors and public services in their assigned sectors; organize and oversee the implementation of the law concerning the respective sector nationwide.
The duties and powers of Ministers and Heads of equivalent agencies as heads of ministries, equivalent agencies, according to Article 19 of the Law on Organization of the Government of Vietnam 2025 are as follows:
- Submit to the Government of Vietnam or the Prime Minister of the Government of Vietnam for consideration and decision within authorities or to competent authorities decision on matters within the state management scope of the assigned sector following the assignment by the Government of Vietnam and directives of the Prime Minister of the Government of Vietnam; propose to the Prime Minister the appointment, dismissal, temporary suspension, removal, or resignation of Deputy Ministers or Deputy Heads of equivalent agencies; recommend to the Prime Minister to suspend the implementation of the provincial People’s Councils’ resolutions contrary to the Constitution, laws, and documents from higher-level state agencies concerning sectors under management responsibility.
- Issue legal normative documents within authority to perform state management functions and duties concerning the assigned sector; issue strategies, plans, policies, and developments of the assigned sector as per the legal provisions.
- Direct, steer, and bear individual responsibility for all work-related aspects of the ministry or ministry-equivalent agency following legal regulations; direct units within management scope to organize the implementation of approved strategies, plans, programs, projects, and duties assigned by the Government of Vietnam, the Prime Minister of the Government of Vietnam.
- Decide within authority issues within the function, tasks, and authority of the ministries or ministry-equivalent agency which they head as per legal regulations.
- Proactively coordinate closely with agencies of the Communist Party, National Assembly, President, Supreme People's Court, Supreme People's Procuracy, State Audit of Vietnam, Central Committee of the Vietnam Fatherland Front, and central agencies of political-social organizations; provide explanations on matters of interest to the Ethnic Council, Committees of the National Assembly; respond to inquiries from National Assembly deputies, petitions from voters, petitions from the Vietnam Fatherland Front, and political-social organizations on matters of management responsibility.
- Guide and inspect, cooperate with other ministries, equivalent agencies, and agencies under the Government of Vietnam in performing tasks concerning the assigned sector; recommend to the Ministers or Heads of other equivalent agencies the suspension or repeal of regulations issued by these agencies contrary to the Constitution, laws, and documents from higher-level state agencies or from the ministry, equivalent agencies on the sectors managed by the ministry, equivalent agencies. In cases where recommendations are not accepted, report to the Prime Minister of the Government of Vietnam for decision-making.
- Direct, guide, and check the implementation by People’s Committees at all levels of tasks concerning the assigned sector or those assigned by the Government of Vietnam or the Prime Minister of the Government of Vietnam.
- Propose to provincial-level People’s Committees, Chairpersons of provincial-level People’s Committees to suspend or repeal regulations by provincial-level People’s Committees or their Chairpersons contrary to documents concerning the assigned sector. If provincial-level People’s Committees or their Chairpersons do not comply, report to the Prime Minister of the Government of Vietnam for a decision.
- Perform other tasks and authority as assigned by the Government of Vietnam, the Prime Minister of the Government of Vietnam.
The Law on Organization of the Government of Vietnam 2025 is effective from March 1, 2025.
The Law on Organization of the Government of Vietnam 2015 (amended and supplemented by Law No. 47/2019/QH14 and Law No. 20/2023/QH15) ceases to be effective from the date the Law on Organization of the Government of Vietnam 2025 is effective.
