Recently, Decree 94/2009/ND-CP provided guidance on the amended Law on Drug Prevention, regarding post-rehabilitation management in Vietnam.
Policies of Commendation and Discipline for Post-Rehabilitation Individuals at the Center in Vietnam
Pursuant to Article 31 of Decree 94/2009/ND-CP, it is stipulated that during the implementation period of the decision for post-rehabilitation management, individuals making progress or achieving excellent results are commended with the following forms in Vietnam:
- Commendation;
- Suggestion for reduction or exemption from the implementation period;
- Other forms as prescribed by law.
Simultaneously, the Director of the Center shall decide the disciplinary actions for post-rehabilitation individuals under management at the Center who violate the center's rules and regulations with the following forms:
- Reprimand;
- Warning;
- Education in the disciplinary room;
- Other disciplinary forms as prescribed by law.
Note:
- The Director of the Center shall decide the disciplinary action in the form of education in the disciplinary room for a maximum of seven days per decision. The person placed in the disciplinary room must write a self-assessment report and present it before the entire management unit.
- The reward and disciplinary decisions must be in writing and included in the post-rehabilitation individual's file.
- In cases where individuals violate the law, depending on the nature and severity of the violation, they may be subject to administrative penalties, transfer to a treatment facility, educational center, or face criminal prosecution; if causing material damage, they must compensate according to legal regulations.
