On January 12, 2024, Vietnam Social Insurance issued Plan 86/KH-BHXH on reviewing documents of Vietnam Social Insurance in 2024.

Plan to review documents of Vietnam Social Insurance in 2024

The purpose of reviewing the documents of the Vietnam Social Security in 2024 is to comprehensively evaluate the system of guiding documents, operational instructions, regulations, and rules that have a regulatory scope across the entire Industry issued by the Vietnam Social Security. Based on that:

- Prepare and publish lists of documents that are no longer valid and documents that are still in effect to make the document system of Vietnam Social Insurance public and transparent.

- Propose amendments, supplements, and replacements of documents that are no longer appropriate, overlapping, or contradictory to ensure the unity and synchronization of the document system.

- Propose the cancellation and annulment of documents with illegal content (if any) to ensure the legality of the document.

- Propose the issuance of new documents for necessary fields and vacant fields without adjustment documents to promptly meet requirements arising in practice.

Subjects of review are professional guidance documents, regulations, and guidelines that regulate the entire industry issued by Vietnam Social Insurance, including:

- Decide to promulgate regulations, rules, and professional processes that cover the entire Sector;

- Official dispatch providing professional guidance for the entire Sector;

- Other documents containing professional and industry-wide guidance.

Regarding the scope of review:

- Documents issued by Vietnam Social Insurance during the period from January 1, 2023, to December 31, 2023, in all professional fields;

- Documents issued by Vietnam Social Insurance before January 1, 2023 but have expired (partially/fully) or need to be amended, supplemented, or replaced during the implementation process.

The work contents of the work reviewing documents for Vietnam Social Insurance in 2024 include:

- Develop a plan to review documents of Vietnam Social Insurance in 2024

- Make a list and summarize the list for review

+ Gather and classify documents; make a list of documents subject to review; and send them to the Legal Department

+ Synthesize and complete the list of documents subject to review and send them to units and social insurance agencies in provinces and cities.

- Review documents and synthesize review results

+ Compare and contrast the provisions in the documents with relevant legal documents still in effect at the time of review to identify contents that are not in accordance with the law.

+ Compare the Industry's professional guidance documents (within the scope of functions and tasks of the unit) with each other to detect overlaps and contradictions.

+ Evaluate the consistency, synchronization, feasibility, and suitability of documents issued by Vietnam Social Security with local professional practices (according to the list of documents sent by Vietnam Social Security)

+ Synthesize suggestions from provincial and city social insurance agencies; - Prepare 04 summary forms, including: + List of valid documents; + List of documents that have expired; + List of documents proposed for amendment, supplement, replacement, or cancellation; + New list of documents to be issued. - Send comments to professional units

+ Summary of review results of units.

- Develop reports and draft Decisions approving plans for handling review results

+ Develop reports and propose plans to handle review results and submit them to heads of the sector for approval

+ Develop a draft decision to announce the list of documents that have expired; The document is still valid and has been submitted to head of the sector for signature and promulgation.

- Publish and carry out the plan for handling review results

+ Publish on the Vietnam Social Insurance Portal, Social Insurance Newspapers and Magazines.

+ Implement the approved plan for handling review results.
