Plan to form legislative documents on land for 2024 of the Ministry of Natural Resources and Environment of Vietnam (Internet image) 

On March 19, 2024, the Minister of Natural Resources and Environment issued Decision 678/QD-BTNMT on the implementation plan of Decision 222/QD-TTg in 2024 on implementing the Land Law 2024.

Plan to form legislative documents on land for 2024 of the Ministry of Natural Resources and Environment of Vietnam

(1) Assign a unit to preside over and coordinate the development of legislative documents on land

* Assigning the unit in charge of construction:

- The Department of Land presides and coordinates with relevant units to develop 02 Decrees.

- The Legal Department presides and coordinates with relevant units to develop a Decree.

- The Department of Land Resources Planning and Development presides over and coordinates with relevant units to develop 02 Decrees and 07 Circulars under the promulgation authority of the Minister of Natural Resources and Environment.

- The Department of Land Registration and Information Data shall preside over and coordinate with relevant units to develop the 01 Decree and 10 Circulars under the promulgation authority of the Minister of Natural Resources and Environment.

(List of documents and completion time are in the attached Appendix)

* Assigning units to coordinate the development of documents detailing and guiding the implementation of the Land Law drafted by other ministries and branches:

- The Department of Land presides and coordinates with relevant units to research and provide comments on the draft Decree detailing rice cultivation land drafted by the Ministry of Agriculture and Rural Development.

- Department of Land Resources Planning and Development presides over and coordinates with relevant units to research and provide comments on the draft Decree regulating land development funds, the draft Decree regulating the collection of land use fees and land rents, which was assigned to draft by the Ministry of Finance, and the draft Decision of the Prime Minister stipulating mechanisms and policies on employment and vocational training for people whose land is recovered, which was assigned to draft by the Ministry of Labor, War Invalids, and Social Affairs.

- Department of Land Registration and Information Data takes the lead and coordinates with relevant units to research and provide comments on the draft Circular on the level of collection, payment, management, and use of fees for exploitation and use of land documents, presided over by the Ministry of Finance; a draft circular regulating the preparation and management of administrative unit boundary records chaired by the Ministry of Home Affairs.

(2) Responsibilities of units in developing legislative documents

* Responsibilities of the Head of the Unit assigned to preside over drafting legislative documents:

- Directly take charge, direct, and be responsible to the Minister for quality, progress, order, procedures, and documents according to regulations in the process of drafting legislative documents.

- Direct the drafting of document content as assigned; synthesize the content and documents of draft documents according to the provisions of law on promulgation of legislative documents sent by the units coordinating to draft the content, ensuring progress according to the document development plan. .

- Closely coordinate with relevant units in the process of developing and promulgating documents; coordinate with the Department of Legal Affairs and relevant units to resolve or promptly report and seek direction from the Ministry's Leaders on difficulties and problems during the document drafting process.

* Responsibilities of the Legal Department:

- Coordinate with units assigned to preside over drafting documents throughout the process of developing legislative documents.

- Organize the appraisal of Circulars and submit them to the Minister for promulgation to ensure quality and progress according to the provisions of law on the promulgation of legislative documents.

* Responsibilities of relevant units under the Ministry:

- Appoint officials to join the drafting committee, editorial team, and drafting team of legislative documents on land when requested.

- Actively coordinate with agencies and units in charge of drafting documents according to assigned functions and tasks; be responsible for the content of comments, quality, and progress within the required time.

- Send comments to the presiding unit at point b, subsection 1.1, section I for synthesis and reporting to the Ministry's leadership to ensure quality and progress as required.
