Plan for verifying assets and income for 2024 in Vietnam of the Supreme People's Court (Internet image) 

Regarding this issue, LawNet would like to answer as follows:

On January 30, 2024, the Chief Justice of the Supreme People's Court issued Decision 22/QD-TANDTC on the Asset and Income Verification Plan for 2024.

Plan for verifying assets and income for 2024 in Vietnam of the Supreme People's Court

Specifically, the content of the Asset and Income Verification Plan for 2024 will include the following main contents:

(1) Verification content

Verify the truthfulness, completeness, and clarity of the content of the declaration of assets and income (hereinafter referred to as the declaration) of the person obliged to declare.

(2) Verified subject

- Agencies and units verified in 2024

Pursuant to the Law on Anti-Corruption 2018 and Clause 2, Article 15 of Decree 130/2020/ND-CP, in 2024, the Supreme People's Court's asset and income control agency will verify the assets and income of the person obliged to declare at 05 People's Court agencies, specifically as follows:

+ High People's Court in Hanoi;

+ Two-level People's Court of Hai Phong city;

+ Two-level People's Court of Thua Thien Hue province;

+ Two-level People's Court of Tien Giang province;

+ Two-level People's Court of Long An province.

- Verified individuals

+ People who are obliged to declare assets and income specified in Article 10 of Decree 130/2020/ND-CP.

+ At each agency or unit, at least 10% of the people responsible for declaring assets and annual income are selected. The specific number of people at agencies and units has an appendix issued with this Plan.

+ Total number of verified people: 60 people.

(3) Criteria and form of selecting people to be verified

- Selection criteria

+ The person selected to verify assets and income meets the following criteria:

As a person obliged to declare assets and annual income;

Assets and income have not been verified for the previous 4 years.

+ Do not choose to verify the assets and income of the following people:

People being investigated, prosecuted, or tried;

People who are being treated for a serious illness certified by a competent medical agency;

People who are studying or working abroad for 12 months or more.

- Form of selection

+ The asset and income control agency randomly selects people by drawing lots to determine verified people at each agency and unit.

+ When selecting the person to be verified, the Asset and Income Control Agency invites a representative of the Party Committee Inspection Committee of the Supreme People's Court to attend and witness.

+ The selection of the person to be verified is recorded in writing.

(4) Procedure for conducting verification

- The Chief Justice of the Supreme People's Court issued the Decision to verify and establish the Asset and Income Verification Team according to Article 45 of the Law on Anti-Corruption 2018.

- The organization and operations of the Asset and Income Verification Team comply with the provisions of Article 46 of the Law on Anti-Corruption 2018.

- The asset and income verification team verifies assets and income for those selected for verification.

- At the end of the verification at each unit, the Head of the Asset and Income Verification Team reports the results, drafts the Verification Conclusion, and submits it to the Chief Justice of the Supreme People's Court to issue the Verification Conclusion.

- The publication of the Asset and Income Verification Conclusion is carried out like the publication of the declaration of assets and income specified in Article 39 of the Law on Anti-Corruption 2018.
