On October 24, 2022, the People's Court issued Decision 329/QD-TANDTC on the Plan for Verification of Assets and Income in 2022.

1. The goal and requirements of the Plan for Verification of Assets and Income in 2022 of Vietnam

**Purpose

- Verification of assets and income of persons obliged to declare assets and income (hereinafter referred to as "persons obliged to declare") in order to review and evaluate the accuracy and conclusion of the truthfulness of the declaration of assets and income; control fluctuations in assets and income of the person who is obliged to declare.

- Verification of assets and income in order to prevent, detect, and handle corrupt acts (if any) and build a clean, integrity-driven, and strong contingent of cadres and civil servants.

**Request

- The verification of assets and income is carried out by the Income and Assets Control Authority of the Supreme People's Court (Inspection Board) according to the procedures and orders specified in the Law on Anti-Corruption 2018 and Decree 130/2020/ND-CP.

- The verification of assets and income is carried out promptly, openly, objectively, and honestly.

- All violations by agencies, organizations, and individuals in the control of assets and income must be handled strictly and promptly in accordance with the law.

2. Verification of Assets and Income in Vietnam 2022

2.1. Agencies and units having assets and income verified in 2022.

Pursuant to the Law on Anti-Corruption 2018 and Clause 2, Article 15 of Decree 130/2020/ND-CP, in 2022 the Income and Asset Control Authority of the Supreme People's Court will conduct asset verification and income of the obligor to declare at 02 agencies and units in the People's Court, specifically as follows:

- Two-level People's Court of Lai Chau province;

- Two-level People's Court of Ca Mau province;

2.2. Individuals having assets and income verified in 2022

- Persons obliged to declare assets and income as prescribed in Article 10 of Decree 130/2020/ND-CP

- At each agency or unit to be verified, select at least 10% of the people who are obliged to declare their annual income assets. The number of people who are obliged to declare their assets and annual income at the court agencies and units subject to verification is specified in the Appendix attached to this Plan.

- Total number of people verified: 20 people.

3. Selection criteria and methods for verifying assets and income in Vietnam 2022

**Selection Criteria

The person selected to verify assets and income meets the following criteria:

- Being a person who is obliged to declare assets and income;

- The assets and income have not been verified for a period of four consecutive years from December 31, 2021, or earlier.

Do not choose to verify the assets and income of the following people:

- Persons being investigated, prosecuted, or tried;

- Persons being treated for a serious illness, certified by a competent health authority;

- Persons who are studying or working abroad for 12 months or more.

**Form of Selection

- The person to be verified at each agency or unit is randomly selected by lottery.

- When selecting the person to be verified, the Asset and Income Control Agency invites a representative of the Party Committee's Inspection Committee at the same level to attend and witness.

- The selection of verified persons shall be recorded in writing.

Decision 329/QD-TANDTC takes effect from the date of signing and promulgation.
