The Ministry of Planning and Investment of Vietnam has approved a plan to simplify administrative procedures related to the establishment and operation of cooperatives.

On May 20, 2024, the Minister of Planning and Investment issued Decision 1185/QD-BKHDT approving the plan to simplify administrative procedures for the establishment and operation of cooperatives under the Ministry of Planning and Investment of Vietnam.

The plan for simplifying administrative procedures for the establishment and operation of cooperatives in Vietnam includes the following:

(1) Introducing new procedures for Cooperative Establishment Registration

Plan for simplifying administrative procedures:

- Amending the procedures for Cooperative Establishment Notification to shift towards registration of cooperative establishments and allowing online registration of cooperative establishments.

- Regarding implementation methods: adding the option of registration through postal services and registration on electronic platforms to facilitate cooperatives in carrying out administrative procedures, saving time and travel costs.

- Regarding application forms: reducing the required information for declaration in cases where personal identification numbers are provided during cooperative registration, improving the form-filling process, and avoiding unnecessary complexity as personal information is already available in the national database on population.

- Developing application forms for "Cooperative Registration Proposal" and "Cooperative Members List" with the aim of reducing the burden of form filling in cases where personal identification numbers are provided during cooperative registration, simplifying the process, and eliminating the need for redundant information that is already available in the national database on population.

(2) Introducing new administrative procedures for Registration of Changes in Cooperative Registration Information

Plan for simplifying administrative procedures:

- Adding provisions for the registration of changes in cooperative registration information, allowing cooperatives to use electronic identification accounts to carry out this procedure on electronic platforms.

- Regarding implementation methods: adding the option of registration through postal services and registration on electronic platforms to facilitate cooperatives in carrying out administrative procedures, saving time and travel costs.

- Regarding application forms: reducing the required information for declaration in cases where personal identification numbers are provided during cooperative registration, improving the form-filling process, and avoiding unnecessary complexity as personal information is already available in the national database on population.

- Developing an application form for "Proposal for Registration of Changes in Cooperative Registration Information" to simplify the form-filling process and avoid redundancy in cases where personal identification numbers are provided during cooperative registration, considering the availability of information in the national database on population.

(3) Introducing new administrative procedures for Termination of Cooperative Operations

Plan for simplifying administrative procedures:

- Amending the administrative procedures for notifying the termination of cooperative operations by adding provisions for the registration of termination of cooperative operations and allowing cooperatives to use electronic identification accounts to carry out this procedure on electronic platforms.

- Regarding implementation methods: adding the option of registration through postal services and registration on electronic platforms to facilitate cooperatives in carrying out administrative procedures, saving time and travel costs.

- Regarding application forms: reducing the required information for declaration in cases where personal identification numbers are provided during cooperative registration, improving the form-filling process, and avoiding unnecessary complexity as personal information is already available in the national database on population.

- Developing an application form for "Notification of Termination of Cooperative Operations."

(4) Supplementing regulations on Temporary Business Suspension Notification and Resumption of Business Operations for cooperatives

Plan for simplifying administrative procedures:

- Adding provisions for the registration of temporary business suspension and resumption of business operations for cooperatives, allowing cooperatives to use electronic identification accounts to carry out this procedure on electronic platforms.

- Regarding implementation methods: adding the option of registration through postal services and registration on electronic platforms to facilitate cooperatives in carrying out administrative procedures, saving time and travel costs.

- Regarding application forms: reducing the required information for declaration in cases where personal identification numbers are provided during cooperative registration, improving the form-filling process, and avoiding unnecessary complexity as personal information is already available in the national database on population.

(5) Supplementing provisions on Suspending Cooperative Registration Procedures

Plan for simplifying administrative procedures:

- Supplementing provisions on suspending Cooperative Registration Procedures to enable cooperatives to use electronic identification accounts for conducting procedures in the electronic environment.

- Regarding implementation methods: adding the option of registration through postal services and registration on electronic platforms to facilitate cooperatives in carrying out administrative procedures, saving time and travel costs.

- Regarding application forms: reducing the required information for declaration in cases where personal identification numbers are provided during cooperative registration, improving the form-filling process, and avoiding unnecessary complexity as personal information is already available in the national database on population.

(6) Supplementing provisions on Requesting Revocation or Cancellation of Cooperative Registration Certificate

Plan for simplifying administrative procedures:

- Supplementing provisions on requesting revocation or cancellation of Cooperative Registration Certificate to enable cooperatives to use electronic identification accounts for conducting procedures in the electronic environment.

- Regarding implementation methods: adding the option of registration through postal services and registration on electronic platforms to facilitate cooperatives in carrying out administrative procedures, saving time and travel costs.

More details can be found in Decision 1185/QD-BKHDT, which comes into force from May 20, 2024.
