On October 21, 2024, the Minister of Finance issued Decision 2494/QD-BTC concerning the Plan to implement Decision 714/QD-TTg on the Plan to implement Regulation 132-QD/TW on power control, anti-corruption, and anti-misconduct in investigation, prosecution, trial, and judgment enforcement activities in Vietnam.

The contents of the implementation tasks for the Plan for power control, anti-corruption, and anti-misconduct in investigation and trial of the Ministry of Finance of Vietnam are as follows:

(1) Disseminate and propagate Regulation 132-QD/TW, Decision 714/QD-TTg; enhance awareness and responsibility concerning power control, preventing and combating corruption and misconduct in judicial proceedings, execution of judgments, and other related activities.

- Thoroughly disseminate and propagate all principles, content, methods, and responsibilities concerning power control, preventing and combating corruption, and misconduct in judicial proceedings, execution of judgments and other related activities; the acts of exploiting, abusing positions and powers, overstepping authority, corruption, misconduct in judicial proceedings, execution of judgments during the performance of duties and powers as per Regulation 132-QD/TW and relevant regulations of the Communist Party and the State.

- Increase the awareness and responsibility of the heads of agencies, organizations, leadership team members, and those with authority in judicial, enforcement agencies, and other relevant agencies in management, direction, and administration activities to implement power control, prevent and combat corruption, and misconduct in judicial proceedings, execution of judgments, and other related activities.

(2) Focus on building, perfecting mechanisms, policies, and laws, and strictly implementing legal regulations on judicial activities, execution of judgments, and other related activities; review, amend, supplement working regulations, rules, operational processes, ethical standards, and codes of conduct in judicial activities, execution of judgments, and other related activities.

- Review, amend, supplement and promulgate legal documents related to judicial activities, execution of judgments, and other related activities, ensuring tightness, synchronization, and consistency with Regulation 132-QD/TW and related Communist Party regulations, preventing loopholes that could be exploited, abused in position and power, overstepping authority, corruption and misconduct.

- Continue to build, promulgate, and enhance the effectiveness of legal provisions regarding the organization, activities, duties, powers of authorities, organizations, and individuals with authority in judicial activities, execution of judgments, and other related activities, ensuring tightness, synchronization, and consistency with Regulation 132-QD/TW, Communist Party guidelines, regulations, and relevant law in Vietnam.

Strictly implement legal regulations on judicial activities, execution of judgments, and other related activities, where all power is tightly controlled and monitored by mechanisms, bound by responsibilities, and the higher the authority, the greater the responsibility.

- Review, amend, supplement working regulations, rules, operational processes, ethical standards, codes of conduct to ensure compliance with the law, ensure openness, transparency associated with public access to information according to law, independence, and objectivity.

(3) Closely monitor the implementation of tasks and powers of the units under and affiliated with the Ministry of Finance and individuals with authority in judicial activities, execution of judgments, and other related activities.

- Organize the proper and full implementation of tasks and powers, operations of authority-conducting agencies, organizations in judicial activities, execution of judgments, and other related activities according to Communist Party rules and State law.

- Strengthen the responsibility of setting examples by leaders, collectives in leadership, ensure openness, transparency, accountability, and regularly carry out self-criticism and criticism work.

- Enhance the effectiveness of inspection, supervision, and examination of the implementation of tasks and powers; compliance with Communist Party guidelines, State laws, working regulations, rules, professional processes, ethical standards, codes of conduct, with enhanced internal inspection, supervision, special and specialized internal audits. Regularly self-inspect, self-evaluate judicial work, execution of judgments, and other related works.

Effectively resolve petitions, reflections, complaints, denunciations in judicial activities, execution of judgments, and other related activities; implement preventive, preventive measures, address acts of violation, exploitation, abuse positions, powers, overstepping authority, corruption, misconduct in judicial activities, execution of judgments and other related activities per Communist Party regulations and State law.

- Build and perfect the organizational apparatus and contingent of cadres, party members, officials, and public employees, ensuring intelligence, impartiality, and a spirit of serving the people in authority-conducting agencies, execution agencies, and other relevant agencies.

- Direct the handling of cases, matters as per Communist Party regulations and State law; require inspection, examination, review decisions of authority-conducting agencies, organizations, and individuals in judicial activities, execution of judgments, and related activities upon receiving well-founded information, requests, petitions, complaints, or denunciations as per Party and State regulations.

Strictly organize the implementation of requests, recommendations, conclusions by inspection, supervision, examination, audit teams; promptly detect and strictly handle collectives, individuals intentionally violating, exploiting, abusing positions, powers, overstepping authority, corruption, misconduct as regulated in Article 6 of Regulation No. 132-QD/TW and other provisions of the Communist Party and State law.

- Provide prompt protection to individuals who detect, reflect, report, denounce, accuse, inform, provide information on violations, exploitation, abuse of positions, powers, overstepping authority, corruption, negative activities in judicial conduct, execution of judgments, and other related activities; handle serious cases of exploiting reflection, petitions, false denunciations, distortion, offending the reputation of agencies, organizations, individuals, and other power-control measures, violation prevention, and corruption, misconduct.

(4) Collaborate with the Supreme People's Procuracy, Supreme People's Court, party committees, political-social organizations to carry out power control, anti-corruption, and prevention of misconduct in judicial activities, execution of judgments, and other related activities.

- Enhance the effectiveness of the checking and supervision mechanisms of party committees, political-social organizations over the implementation of tasks and powers by authority-conducting agencies, execution agencies, and other relevant bodies.

- Strictly implement the requests, inspection conclusions, decisions on protest, recommendations of the People's Procuracy; legally effective judgments of the People's Court; closely coordinate with the Supreme People's Procuracy, Supreme People's Court in prosecution activities, exercising the right to prosecute, supervising judicial activities, conducting trials, implementing requests, recommendations, protests, explanations, correcting judgments, decisions of the Court to ensure that effective judgments are executed.
