On July 9, 2023, the Prime Minister of Vietnam issued Directive 23/CT-TTg on accelerating the reform of administrative procedures for the issuance of judicial record cards to facilitate people and businesses.

According to Directive 23/CT-TTg, the Prime Minister requested the Ministry of Public Security of Vietnam to take the lead and coordinate with relevant agencies and localities to perform the following tasks:

- Taking charge and cooperating with the Ministry of Justice, the Ministry of National Defense, the Supreme People's Court, the Supreme People's Procuracy, and relevant agencies to connect and share the national database on population with the judicial record database, the database of the civil judgment enforcement agency, the database managed by the Public Security branch, the database of the Ministry of National Defense, the Supreme People's Court, and the Supreme People's Procuracy to serve the issue of judicial record cards and handle administrative procedures in accordance with the law.

- Coordinating with the Ministry of Justice, the Ministry of Information and Communications, and the People's Committee of Thua Thien Hue province to research and develop a solution to pilot the issuance of judicial record cards on the VNeID application according to Resolution 74/NQ-CP.

On that basis, make a preliminary review and report to the competent authorities on the nationwide implementation.

Thus, according to Directive 23/CT-TTg, the pilot implementation of the issuance of judicial record cards on VNeID applications according to Resolution 74/NQ-CP will be implemented in Thua Thien Hue.

Pilot decentralization of the issuance of judicial record cards to the Justice Department under the district-level People's Committee in Vietnam

In order to strengthen the reform of administrative procedures in receiving and handling requests for the issuance of judicial record cards in order to facilitate and reduce time and social costs for people, the Prime Minister requested the Ministry of Justice to assume the prime responsibility for and coordinate with the Ministry of Public Security and relevant agencies in:

- Decentralizing the Department of Justice to exploit and search the Judicial Records Database at the National Center for Judicial Records to serve the issuance of judicial record cards in order to increase initiative, take responsibility, and reduce implementation time and costs.

- Advising the Government to report to the National Assembly on the pilot decentralization of the issuance of judicial record cards to the Justice Department under the district-level People's Committees in Hanoi city and Nghe An province, and submit it to the Government as soon as possible.

- Accelerating digitization, perfecting the judicial record database, connecting and sharing data in service of issuing judicial record cards, and handling administrative procedures for people.

- Expeditiously reviewing and proposing to reduce the fee for providing judicial record information to encourage the implementation of online public services to the Ministry of Finance under the direction of the Prime Minister in Document No. 3561/VPCP-KSTT dated May 18, 2023 of the Office of the Government.

- Coordinating with the Ministry of Public Security to research and develop a solution to pilot the issuance of judicial record cards on the VNeID application as required in Resolution 74/NQ-CP dated May 7, 2023 of the Government.

Therefore, the Justice Department under the district-level People's Committees in Hanoi city and Nghe An province will be piloted to decentralize the issuance of judicial record cards.

Providing the service of returning the results of processing the application for the issuance of a judicial record card at home

Specifically, the Ministry of Information and Communications shall assume the prime responsibility for, and coordinate with press agencies in, propagating regulations on the issuance of judicial record cards for organizations and businesses to understand and properly implement, limiting the abuse of asking people to provide judicial record cards;

Directing public-utility postal service providers to closely coordinate with agencies that issue judicial record cards to provide services of receiving and returning the results of processing dossiers for issuance of judicial record cards at home when people have needs.
