Resolution 98/2023/QH15 on piloting a number of specific mechanisms and policies for the development of Ho Chi Minh City was approved by the National Assembly on June 24, 2023.

According to Resolution 98/2023/QH15, the fee and charge policies that will be piloted in Ho Chi Minh City include:

(i) The City People's Council decides to apply in the area: fees and charges not yet specified in the List of fees and charges promulgated together with the Law on Fees and Charges; to adjust the fee and charge collection rate or rate decided by the competent authority for the charges and fees specified in the List of fees and charges promulgated together with the Law on Fees and Charges, except for court fees and fees belonging to the central budget's revenues, 100%;

(ii) The City Budget is entitled to 100% of the additional revenue from revenues due to the adjustment of the fee and fee policy specified at Point a of this Clause to invest in socio-economic infrastructure and other expenditure tasks under the expenditure tasks of the City budget;

These revenues are not used to determine the percentage (%) of the revenues divided between the central budget and the City budget;

(iii) The pilot implementation of the fee and fee policy in the City's area specified in (i) must ensure a roadmap, consistent with the City's development capabilities and requirements; create a favorable business and production environment for enterprises; ensure market consistency; not obstruct the circulation of goods and services;

Make reasonable adjustments to the goods, services, and lawful income sources of organizations and individuals in the city; ensuring publicity, transparency, and state administrative reform.

Pilot model of urban development in the direction of public transport development in Vietnam

The urban development model oriented to public transport development (TOD) will be piloted in Ho Chi Minh City as follows:

(i) The City People's Council decides to use the local budget to implement an independent public investment project for compensation, support, and resettlement for investment projects according to separate urban design projects, urban planning projects in the vicinity of stations belonging to the railway lines approved by the competent authorities, the vicinity of the intersections along Ring Road 3 in the territory of the city to acquire land, embellish and develop urban areas, carry out resettlement, and create a land fund for auction to select investors for investment projects in urban development, commerce, and services in accordance with the provisions of the law;

(ii) The authority, order, and procedures for investment and construction for compensation, support, and resettlement projects specified at Point a of this Clause shall be implemented according to the competence, order, and procedures of group A public investment project according to the criteria prescribed by the law on public investment;

(iii) For the vicinity of stations and intersections specified at point a of this clause, The City People's Committee may decide to adjust the construction density, technical and social infrastructure criteria compared with the provisions in the national technical regulations on construction planning for existing urban areas, but must ensure that the technical and social infrastructure systems are satisfied and the architectural planning criteria are determined in the content of the zoning planning project, the city's general plan;

(iv) The land acquisition for the projects specified in (i) must fully satisfy the following conditions:

+ The project has an approved investment policy and belongs to the city's medium-term public investment plan;

+ The location, boundary, and land area of the project in the vicinity have been determined in the urban planning project, separate urban design project, land use planning, and annual land use plan at the district level.
