Persons are not allowed to be members of the Examination Council for officials and public employees in Vietnam

This is a notable content of the Circular No. 6/2020/TT-BNV on organizational regulations; regulations on recruitment examination, consideration for recruitment of officials and public employees, examination for promotion of officials rank, examination or consideration for promotion of professional titles of public employees, issued by the Ministry of Home Affairs of Vietnam on December 02, 2020.

According to Article 1 of the Regulation issued together with the Circular No. 6/2020/TT-BNV of the Ministry of Home Affairs of Vietnam, it is not permitted to appoint the following persons to be members of the Council: persons who are related as biological father, mother, brother, sister, or of a spouse, or a biological or adopted child of candidate for recruitment of officials, public employees, officials rank promotion exam, public employee professional title promotion or persons who are in the disciplinary period or are executing a disciplinary decision.

This Article also stipulates that:

- Council for recruitment of officials and public employees; Examination Council for officials promotion; Council for the promotion of professional titles of public employees (collectively referred to as the Council) is established by the head of the agency or unit competent to recruit or organize the officials rank promotion exam, the public employee's professional title promotion. The Council operates according to each recruitment period or exam for officials promotion, promotion to public employee professional title and self-dissolution after completing tasks.

- The Council for officials recruitment (examination and admission) shall perform the tasks and powers specified in Clause 2 Article 7 of Decree No. 138/2020/NĐ-CP of Vietnam’s Government.

- The Council for public employee recruitment (examination and admission) shall perform the tasks and powers specified in Clause 3 Article 8 of Decree No. 115/2020/NĐ-CP of Vietnam’s Government.

- The Council for the examination for promotion of officials rank shall perform the tasks and powers specified in Clause 2 Article 35 of Decree No. 138/2020/NĐ-CP of Vietnam’s Government.

- The Council for the promotion of public employee professional titles (promotion exam, consideration for promotion) shall perform the tasks and powers specified in Clause 2 Article 38 of Decree No. 115/2020/NĐ-CP of Vietnam’s Government.

Note: The Council shall not be established to jointly organize the recruitment of officials and public employees and the examination for promotion of officials ranks or promotion of public employee professional titles.
