Who is considered a public security worker in Vietnam?

According to Clause 6, Article 2 of the Law on People's Public Security 2018, a public security worker is a Vietnamese citizen with technical expertise, recruited to work in the People's Public Security without being ranked as an officer, non-commissioned officer, or soldier.

Permissible age limits for public security workers in Vietnam in 2023

Currently, according to Article 11 of Decree 49/2019/ND-CP, the ermissible age limits for public security workers in Vietnam are as follows: Male 60 years old, female 55 years old.

However, from May 18, 2023, the Law Amending the Law on People's Public Security 2023 will take effect, changing the maximum serving age of public security workers as follows:

Male 62, female 60, and it will follow the retirement age roadmap for workers as stipulated in the Labor Code 2019.

public security workers are entitled to similar policies as national defense workers.

Thus, the maximum serving age for public security workers has increased compared to the period before August 15, 2023, as follows:

- The maximum serving age for male public security workers has increased from 60 to 62 years (an increase of 2 years compared to the current age)

- The maximum serving age for female public security workers has increased from 55 to 60 years (an increase of 5 years compared to the current age)

Furthermore, this age limit may change according to the retirement age roadmap for workers as stipulated in the Labor Code 2019.

Forms and conditions for being discharged for public security workers in Vietnam

Article 12 of Decree 49/2019/ND-CP stipulates the forms and conditions for being discharged for public security workers in Vietnam as follows:

(1) Public security workers are eligible for retirement if they fall into one of the following cases:

- Eligible for pension according to social insurance laws;

- Male from 55 to under 60 years old, female from 50 to under 55 years old, and has 20 years or more of social insurance payment, but due to organizational changes, the People's Public Security no longer needs to allocate them;

- Male 50 years old, female 45 years old, and has 20 years or more of social insurance payment, including 15 years as a public security worker.

(2) public security workers are transferred to another sector with the consent of the competent authority and acceptance by the receiving agency or organization.

(3) public security workers cease working if they belong to one of the following cases:

- Not yet reached the serving age limit as stipulated in Article 11 of Decree 49/2019/ND-CP but wish to cease serving in the People's Public Security and are approved by the competent authority;

- Due to organizational changes, the People's Public Security no longer needs to allocate them and they do not fall into the cases stipulated in Point b, Clause 1 and Clause 2, Article 12 of Decree 49/2019/ND-CP;

- public security workers not falling into case (1) having a quality of ethics not meeting the task requirements or failing to complete duties for two consecutive years or not meeting health standards;

- Eligible for retirement according to (1) but wish to receive one-time social insurance payment to settle abroad or suffering from life-threatening diseases such as cancer, paralysis, cirrhosis with ascites, leprosy, severe tuberculosis, HIV that has transitioned to AIDS, and other diseases as stipulated by the Ministry of Health.
