Percentage of Insurance Contribution for Deputy Commander of the Commune/Ward Military Command

Support regime policies for the Command Committee of Military at commune, ward, and township levels are stipulated in Decree 03/2016/ND-CP Guiding the Law on Militia and Self-Defense Forces.

According to the regulations in Article 17 of Decree 03/2016/ND-CP effective from February 20, 2016, policies regarding allowances, social insurance, health insurance, meal expenses, travel expenses, and benefits for the Deputy Commander of the Commune Military Command have been amended as follows:

For the Deputy Commander of the Commune Military Command:

+ The monthly allowance is calculated and paid monthly, based on the statutory pay rate multiplied by a coefficient of 1.0;

+ Be entitled to social insurance benefits and health insurance during the period of holding the position in accordance with the laws on social insurance and health insurance;

+ Meal expenses during training, instruction, and drilling will be equal to the basic meal expenses of infantry soldiers in the Vietnam People's Army;

+ Travel expenses are applied similar to commune-level officials;

+ In cases of continuous service for 60 months or more, if they resign, they are entitled to a one-time allowance, with 1 year of service calculated as 1.5 times the average allowance of the last 60 months, except for cases of voluntary resignation, disciplinary discharge, or deprivation of citizenship rights.

+ The Chairman of the Provincial People's Committee shall submit to the People's Council at the same level to decide on the monthly allowance, meal expenses, support for social insurance contributions, and health insurance for the Deputy Commander of the Commune Military Command; the monthly allowance of the Hamlet Militia Commander; and travel expenses for the militia and self-defense force.

Thus, based on this regulation and the provisions of the Social Insurance Law 2014, the Deputy Commander of the Commune Military Command is required to participate in compulsory social insurance and health insurance. However, the Decree does not specifically stipulate the percentage of social insurance contributions. As stipulated in Clause 4 of this Article, the Chairman of the Provincial People's Committee together with the People's Council will have specific decisions regarding the expenditure and participation rates for social insurance.
