On August 26, 2020, the Government of Vietnam issued Decree 99/2020/ND-CP stipulating penalties for administrative violations in the fields of petroleum, petroleum trading, and gas.
Fine up to 100 million for violations in registering the petroleum distribution system - Illustrative image
Article 22 of Decree 99/2020/ND-CP stipulates penalties for violations regarding the registration of petroleum distribution systems and the purchase and sale of petroleum according to the distribution system as follows:
- Failing to register the distribution system with the competent state management agency as prescribed;- Fraud in declaring the registration of the distribution system;- Failing to send the information of the petroleum distribution system to the agency or franchisor for registering the distribution system with the competent state management agency as prescribed.
A fine double the amount specified for the violations stipulated in points a and b, clause 1 of this Article shall be imposed if the perpetrator is a key trader.
A fine ranging from VND 40,000,000 to VND 60,000,000 shall be imposed on general petroleum agents, retail petroleum agents, franchised petroleum traders, and retail petroleum stores for buying or selling petroleum to entities outside the distribution system, except for direct sale to consumers.
A fine ranging from VND 60,000,000 to VND 100,000,000 shall be imposed for any of the following violations:
- Petroleum distributors buying or selling petroleum to entities outside the distribution system, except for buying from key traders, other petroleum distributors, and selling directly to consumers;- Key traders selling petroleum to entities outside their distribution system, except for selling to other key traders, petroleum distributors, direct production units, and consumers directly.
