Comment on the draft Decree amending and supplementing Decree 78/2021/ND-CP 

The Ministry of Agriculture and Rural Development issued Official Dispatch 7461/BNN-DD in 2023 providing comments from localities on the draft Decree amending Decree 78/2021/ND-CP on the establishment and management of the Natural Disaster Prevention Fund in Vietnam.

To continue completing the draft Decree, the Ministry of Agriculture and Rural Development respectfully requests the People's Committees of provinces and centrally run cities to implement the following contents:

- Report summarizing the implementation of Decree 78/2021/ND-CP on the establishment and management of the Natural Disaster Prevention and Control Fund according to the attached Outline.

- Provide comments on the draft Decree, focusing on comments on a number of regulations related to the Provincial Fund, such as: abolishing regulations on the operation of the Disaster Prevention Fund following the model of a one-member limited liability company with 100% charter capital held by the state; subjects eligible for exemption or reduction of contributions; Report and approve the settlement of the Provincial Fund.

Issued together with this document is the appendix on the outline report summarizing the implementation of Decree 78/2021/ND-CP on the establishment and management of the Natural Disaster Prevention Fund.

The content of the outline report summarizing the implementation of Decree 78/2021/ND-CP on the establishment and management of the Natural Disaster Prevention Fund includes:

“I. GENERAL SITUATION

1. Directing the implementation of Decree 78/2021/ND-CP.

Clearly state the number, name, and form of documents (Official Dispatches, Decisions, Plans, Regulations....) that have been issued to direct the implementation of the Decree.

2. Propaganda and dissemination of regulations of Decree 78/2021/ND-CP

- Clearly state the forms of propaganda and dissemination: workshops, conferences, news reporting, articles on mass media, compilations of documents, books, handbooks, etc.

- Clearly state the number of news and articles; document; book; notebook; seminars and conferences; number of people/turns of people propagated, disseminated, etc.

3. Inspection and inspection of the establishment and management of the Natural Disaster Prevention and Control Fund.

II. IMPLEMENTATION RESULTS

1. Status of promulgation of documents detailing the implementation of Decree 78/2021/ND-CP.

- Status of issuance of the Decision to establish the Provincial Natural Disaster Prevention and Control Fund.

- Status of issuance of Regulations on organization and operation of the Provincial Natural Disaster Prevention and Control Fund.

- The situation of promulgating detailed regulations on expenditure content and spending levels of the Provincial Fund at the request of the Provincial Fund management agency is specified in Clause 1, Article 17.

- Status of promulgation of regulations by the Chairman of the Provincial People's Committee on the content and level of spending to carry out natural disaster prevention and control tasks at the request of the Provincial Steering Committee for Natural Disaster Prevention and Control and Search and Rescue specified in Clause 2, Article 17.

2. Situation of revenue management and plan for collection and remittance to the Provincial Fund.

3. Situation of provincial fund expenditure.

4. Reporting situation and final settlement approval.

5. Transfer between Provincial Funds.

III. DIFFICULTIES, PROBLEMS, CAUSES AND SUGGESTIONS AND RECOMMENDATIONS

1. Difficulties, problems, limitations, inadequacies, and causes.

2. Propose and recommend amendments and supplements to Decree 78/2021/ND-CP.”
