Organizing the inspection of the fulfillment of obligations of Vietnamese public employees in professional activities

This is an important content in Circular 09/2012/TT-BNV issued on December 10, 2012 by the Ministry of Home Affairs on the procedures and matters regarding the recruitment, employment, and management of Vietnamese officials and public employees to be inspected.

Under Article 42 of Circular 09/2012/TT-BNV, matters regarding the fulfillment of obligations of Vietnamese public employees and performance of prohibitions for Vietnamese public employees to be inspected include:

Regarding the fulfillment of obligations of Vietnamese public employees:

- Fulfillment of general obligations of public employees;

- Fulfillment of obligations of public employees in professional activities;

- Fulfillment of obligations of managerial public employees.

The performance of prohibitions on public employees shall comply with Article 19 of the Law on Public Employees. Other matters are regulated in Section 2, Chapter 2 of the Law on Public Employees and other legal provisions regarding the obligations and prohibitions for public employees.

Additionally, Article 43 of Circular 09/2012/TT-BNV stipulates matters regarding the assessment and grading of Vietnamese public employees to be inspected including:

- Authority and responsibility for assessment and grading of public employees;

- Content, sequence, timing, and method of assessment of public employees in the following cases: Annual assessment; upon completion of the probation period; during planning, appointment, re-appointment of managerial public employees; upon renewal of employment contracts; when dispatched for training and development; when changing job positions; changing professional titles; upon consideration for commendation and discipline.

- Grading results of public employees; notification of assessment and grading results of public employees.

- Other matters are regulated in Section 4, Chapter III of Decree 29/2012/ND-CP dated April 12, 2012, of the Government of Vietnam and other legal provisions regarding the assessment and grading of public employees.
