On December 21, 2023, the Prime Minister issued Decision 31/2023/QD-TTg regulating the functions, tasks, powers, and organizational structure of the National Border Committee under the Ministry of Foreign Affairs in Vietnam.
- The National Border Committee (hereinafter referred to as the Committee) is a general department-level agency under the Ministry of Foreign Affairs, assisting the Minister of Foreign Affairs in performing the function of state management of national borders and territory.
- The Committee has legal status, has a seal with the National Emblem, can open an account at the State Treasury according to the provisions of law, and is headquartered in Hanoi.
- Advise and help the Minister of Foreign Affairs submit to the Government, Prime Minister and competent agencies:
+ Law projects and draft resolutions of the National Assembly; Ordinance projects and draft resolutions of the National Assembly Standing Committee; draft decrees and resolutions of the Government; draft decisions and directives of the Prime Minister on border and national territory work;
+ Draft international treaty on planning, demarcation, and marking of national borders on land; maritime delimitation and international treaties on national borders and border gates between Vietnam and other countries;
+ Plans for planning national borders; determining the boundaries of Vietnam's airspace and sea areas with neighboring countries; determining the scope of Vietnam's sovereignty, sovereign rights, and jurisdiction over Vietnam's land, airspace, seas, and islands;
+ Strategies, national target programs, action programs, schemes, important projects on border work, national territory, or related to national borders and territory.
- Submit to the Minister of Foreign Affairs for consideration and decision:
+ Draft circulars and other documents on border and national territory work;
+ Long-term, medium-term, and annual plans on border and national territory work.
- Organize the implementation of policies, laws, strategies, plans, programs, schemes, and projects on national border and territory work after being promulgated or approved by competent authorities.
- Provide professional guidance on state management of borders and territories according to authority.
- Organize and carry out information and propaganda work, disseminating the Party's guidelines and policies and the State's laws on national borders and territory; international treaties and border legal documents that Vietnam has signed and participated in.
- Research and propose policies for signing and organizing the implementation of international treaties on borders and territories, international treaties on national borders, and border gates between Vietnam and other countries.
- Advise, propose, and organize negotiations to resolve border and territorial issues with relevant countries.
- Direct, guide, organize, and inspect the demarcation and placement of national border markers on the basis of international border treaties signed between Vietnam and neighboring countries.
- Synthesize and evaluate the situation of border and national territory management on the mainland, seas, islands, and airspace of Vietnam; forecast, propose guidelines, policies, and appropriate management measures; and report to the Government according to regulations.
- Help the Minister of Foreign Affairs preside over and coordinate with ministries, ministerial-level agencies, relevant agencies, and localities to inspect, monitor, synthesize the situation, and resolve legal disputes about borders and territories; political, diplomatic, legal, and public opinion struggles to protect Vietnam's borders, territorial integrity, sovereignty, sovereign rights, jurisdiction, and legitimate interests in land border areas, the seas, islands, and airspace of Vietnam, and other legitimate rights and interests of Vietnam in international seas and airspace.
- Develop and propose Vietnam's policies and viewpoints at international forums related to territorial borders; propose policies and develop projects and legal documents to serve the resolution of border and territorial disputes before international judicial bodies; Collect and consolidate documents and evidence as a legal and practical basis to affirm border and territorial sovereignty.
- Carry out international cooperation related to national borders and territories according to the provisions of law; dialogue on issues related to borders and territories with relevant countries and other partners; chair and coordinate the management of organizing international conferences and seminars on borders and territories in Vietnam.
- Advise and propose the development and implementation of guidelines, policies, strategies, planning, and development of the land border gate system nationwide; advise the Government on the policy of opening and upgrading land border gates and measures that need to be implemented to protect the stability and clarity of border lines and national boundary markers.
- Handle or guide the handling of issues arising in the activities of ministries, ministerial-level agencies, relevant agencies, and localities related to sovereignty, sovereign rights, jurisdiction, and national interests on the mainland, seas, islands, airspace, and other legitimate rights and interests of Vietnam in international seas and airspace.
- Help the Minister of Foreign Affairs preside over and coordinate with ministries, ministerial-level agencies, relevant agencies, and localities to build a national database system on borders and territories.
- Appraise maps and publications related to Vietnam's national borders, airspace, sea areas, islands, and archipelagos before publishing and releasing.
- Carry out tasks on administrative reform, digital transformation, application of technology to develop e-Government, digital Government, information security, and safety according to the programs and plans of the Ministry of Foreign Affairs and according to the regulations of the Law.
- Manage organizational structure, payroll, and job positions; implement salary regimes and other regimes and policies on remuneration, training, fostering, emulation, rewards, discipline, and other regimes and policies for civil servants and workers under the management of the Committee according to the provisions of law and decentralization of the Minister of Foreign Affairs.
- Manage finances and assigned assets and organize the implementation of allocated state budget according to the provisions of law.
- Coordinate with the Ministry Inspectorate to inspect and inspect the implementation of legal regulations in the fields of borders and territories, under the state management scope of the Ministry of Foreign Affairs; organize citizen reception; resolve complaints and denunciations; and prevent and combat corruption and negativity according to the provisions of law.
- Perform other tasks and powers as assigned or authorized by the Minister of Foreign Affairs and according to the provisions of law.
