1. Organizational structure of the Fisheries Surveillance Department of Vietnam

The organizational structure of the Fisheries Surveillance Department in Vietnam includes:

- Head of Department:

+ The Fisheries Surveillance Department has a Director and Deputy Directors appointed and dismissed by the Minister of Agriculture and Rural Development as prescribed;

+ The Director of the Department manages the activities of the Department, is responsible before the Minister and before the law for the operation of the Department. The Deputy Director assists the Director in monitoring and directing a number of tasks as assigned by the Director; taking responsibility before the Director and before the law for the assigned tasks;

+ The Director of the Department is responsible for: submitting to the Minister regulations on the functions, tasks, powers, and organizational structure of the Department; defining the functions, tasks, and powers of advisory organizations under the Department; prescribing the functions, tasks, powers, and organizational structure of organizations with legal status under the Department after obtaining written approval from the Ministry; and appointing and dismissing leadership positions of organizations under the Department according to the decentralization of the Minister and the provisions of law.

- Advisory organizations:

+ Office of the Department;

+ Department of Planning and Finance;

+ Department of Organization and Force Building;

+ Professional Division of Fisheries Inspection;

+ Legal Department, Inspector;

+ Division of Aquatic Resources Protection and Development;

+ Department of Science, Technology, and International Cooperation.

- Sub-departments affiliated with:

+ Sub-Fisheries Surveillance Department Region I, head office is located in Hai Phong city;

+ Sub-Fisheries Surveillance Department Region II, located in Quang Nam province;

+ Sub-Fisheries Surveillance Department Region III, headquartered in Khanh Hoa province;

+ Sub-Fisheries Surveillance Department Region IV, located in Ba Ria - Vung Tau province;

+ Sub-Fisheries Surveillance Department Region V, based in Kien Giang province.

- Business units-public:

The Fisheries Control Information Center under the Fisheries Surveillance Department will continue to operate according to current regulations until a decision on consolidation and re-arrangement is issued by the competent authority.

Organizations under the Fisheries Surveillance Department specified in Clauses 3 and 4 of this Article have legal status, their own seals and accounts, and operating funds as prescribed by law.

2. Position and functions of the Fisheries Surveillance Department in Vietnam

- The Fisheries Surveillance Department is an organization under the Ministry of Agriculture and Rural Development, on the basis of arrangement and consolidation of the Directorate of Fisheries into the Fisheries Surveillance Department and the Department of Fisheries.

The Fisheries Surveillance Department performs the function of advising and assisting the Minister of Agriculture and Rural Development in state management and organizing the performance of fishery monitoring and professional fishing tasks; protection and development of aquatic resources; and enforcement of the laws of Vietnam and relevant international treaties on the exploitation and protection of aquatic resources under the scope of state management of the Ministry, according to the decentralization and authorization of the Minister.

- The Fisheries Surveillance Department has legal status, its own seal and account, and its operating budget is in accordance with law.

- The head office of the Fisheries Surveillance Department is located in Hanoi city.

Decision 1789/QD-BNN-TCCB takes effect from May 19, 2023.
