Regarding this matter, LawNet would like to answer as follows:

On December 31, 2023, the Minister of Information and Communications issued Circular 23/2023/TT-BTTTT on amendments to some Articles of Circular 01/2020/TT-BTTTT on elaboration and guidelines for some Articles of the Publishing Law 2012 and Decree 195/2013/ND-CP on elaboration of some articles and measures for implementing the Publishing Law 2012

Order, procedures, and methods of revocation and re-issuance of certificate of editing practice in Vietnam as of May 1, 2024

The order, procedures, and methods of revocation and re-issuance of certificate of editing practice in Vietnam as of May 1, 2024 are as follows

(1) Order, procedures, and methods of revoking the certificate of editing practice specified in Clause 3, Article 20 of the Publishing Law 2012

- The determination of editors whose certificate of editing practice are revoked as prescribed in Clause 3, Article 20 of the Publishing Law 2012 must be recorded in writing by the Authority of Publication, Printing and Distribution;

3. Certificate of editing practice is revoked in the following cases:

a) Editor whose publications are edited are banned from circulation, revoked, confiscated or destroyed;

b) Editor who has edited two publications in 01 year or publications in 02 consecutive years with content violations required correction to be released;

c) Editor has been sentenced by a legally effective judgement of the court.

- Within 05 working days from the date of making the record, the Director of the Authority of Publication, Printing and Distribution must issue a decision to revoke the certificate of editing practice;

- From the date of the decision to revoke the certificate of editing practice, the editor is not allowed to edit manuscripts, put their name on publications and is responsible for returning the certificate of editing practice to the Authority of Publication, Printing and Distribution.

(2) Procedures and method for reissuing an editing practicing certificate specified in Clause 4 Article 20 of the Publishing Law 2012 shall be carried out as follows:

- After 02 years from the date on which the editing practicing certificate is revoked, the editor may request the Authority of Publication, Printing and Distribution to reissue the editing practicing certificate.  The application for reissuance of the editing practicing certificate, using Form No. 05 shall be submitted in person, by post or via online public service system to the Authority of Publication, Printing and Distribution;

- Within 07 working days from the date of receipt of the complete application, the Authority of Publication, Printing and Distribution shall finish reissuing the editing practicing certificate to the editor; in case of refusal, a written reply which clearly states reasons is required.

(3) Procedures and method for reissuing an editing practicing certificate specified in Clause 5 Article 20 of the Publishing Law 2012 shall be carried out as follows:

- Within 15 days from the date on which the editing practicing certificate is lost or damaged, the editor shall submit an application for reissuance of the editing practicing certificate, using Form No. 05 in person, by post or via online public service system to the Authority of Publication, Printing and Distribution;

- Within 05 working days from the date of receipt of the complete application, the Authority of Publication, Printing and Distribution shall finish reissuing the editing practicing certificate to the editor; in case of refusal, a written reply which clearly states reasons is required.
