Order of Management and Utilization of Proceeds from the Sale of State-Owned Shares

Recently, the Ministry of Finance issued Circular 63/2018/TT-BTC replacing Joint Circular 16/2015/TTLT-BKHCN-BTC guiding certain articles of Decree 70/2018/ND-CP on the management and use of assets formed through the implementation of scientific and technological tasks using state funds.

the collection, management, and use of funds obtained from the sale of the State's ownership portion of assets equipped to perform scientific and technological tasks using a portion of the state budget are implemented as follows:

1. Organizations and individuals purchasing the State's ownership portion by making a one-time payment must submit the funds and manage them according to the regulations in Article 3 of Circular 63.

2. Organizations and individuals purchasing the State's ownership portion by making multiple payments:

- Must be approved by the authority or individual as stipulated in Clause 5, Article 21 of Decree 70/2018/ND-CP and recorded in the Asset Sale Contract;- Within 03 working days from the date of receiving the first payment, the agency assigned to manage the scientific and technological tasks must deposit it into a temporary account at the State Treasury, which is under the account holder assigned to manage public assets.- Within 30 days from the date the first payment for the State's ownership portion of the assets is deposited into the temporary account, the managing agency must compile and evaluate the related expenses and submit a written request to the account holder to authorize the payment of these expenses.- Within 15 days from the date of receiving the written payment request, the account holder of the temporary account must disburse the funds to pay the expenses related to the sale of the State's ownership portion of the assets as regulated.- Funds from subsequent payments must be deposited into the temporary account in a similar manner.

3. On a quarterly basis, the account holder of the temporary account must transfer the remaining funds from the sale of the State's ownership portion of the assets, after such funds have been used to cover the costs, to the central and local budgets.

Circular 63/2018/TT-BTC takes effect from September 15, 2018.
