This is a notable content stipulated by the Minister of National Defense in Circular 131/2014/TT-BQP promulgating the Regulations on Managing Evidence Warehouses in the Military.
Currently, the evidence storage facility is the centralized location for storing and securing evidence to serve the investigation, prosecution, trial, and enforcement of judgments. Therefore, agencies, organizations, units, and individuals involved in the management, handover, acceptance, storage, preservation, and inspection of evidence in the Army's evidence storage facility must follow the procedures for handing over and accepting evidence as specified in Circular 131/2014/TT-BQP as follows:
- When there is a need to bring evidence into storage, remove it from storage to serve litigation activities, or transfer it to another evidence storage facility, the head of the handling agency must issue a storage entry order or storage exit order;
- The storage entry order or storage exit order must clearly indicate the type, quantity, weight, and characteristics of the evidence, the reason for storage entry or exit, the date and time of entry or exit; the full name, position of the person delivering or receiving the storage entry or exit order, and it must bear the signature of the head of the handling agency and the stamp of the handling agency;- The storage entry order or storage exit order.
- When handing over or accepting evidence at the evidence storage facility, the person handing over or accepting must present the storage entry, exit order, introduction letter, and identity card. The evidence keeper will only store or release the evidence when all the required documents are complete.
