Recently, the Government of Vietnam has issued Decree No. 70/2010/NĐ-CP elaborating the Law on Atomic Energy regarding nuclear power plants. This Decree has specified the procedures for licensing of electricity activity of nuclear power plants.
According to Article 31 of Decree No. 70/2010/NĐ-CP of Vietnam’s Government:
For official operation of nuclear power plants, organizations with these plants shall make and send dossiers to the Ministry of Industry and Trade for consideration and grant of electricity activity licenses for their nuclear power plants.
- A dossier of application for an electricity activity license for a nuclear power plant must comprise:
+ An application for an electricity activity license;
+ A report on safety analysis after trial operation;
+ An operation program and a fuel renewal plan;
+ A plan on assurance of operation quality;
+ A plan of action in response to incidents;
+ A report on trial operation;
+ The environmental management agency is certified for the realization of contents of the environmental impact assessment report and requirements of the decision approving this report.
The investor must send the safety analysis report after commissioning and the incident response plan to the nuclear and radiation safety agency. This agency is responsible for appraising the above two contents. In addition, the nuclear and radiation safety agency must also propose the issuance of a license to operate a nuclear power plant and submit it to the National Nuclear Safety Council for evaluation of the appraisal results.
- Licensing authority: The Ministry of Industry and Trade shall grant electricity activity licenses for nuclear power plants after consulting the Ministry of Science and Technology and the National Council for Nuclear Safety.
