Circular 17/2017/TT-BCT was issued by the Ministry of Industry and Trade on September 19, 2017, detailing the procedures for business registration at the border market.
To be specific, Circular 17 provides that Chinese traders and border residents conducting business at border markets must register according to the following procedures:
Chinese traders and border residents wishing to do business at the border market (location) must submit 01 (one) set of documents directly or by post to the Department of Industry and Trade or the agency authorized by the Department of Industry and Trade (the district-level People's Committee/district-level town/provincial city); documents include:
- Business registration application at the border market (location).- 01 (one) certified copy (or a copy from the original record or a copy presented with the original for comparison) of the following documents: (i) Contract or agreement with the market management unit (Board, Agency) regarding the rental of stalls, kiosks, shops at the market (if any); (ii) Valid entry and exit documents of border residents or legal representatives of traders (passport or border laissez-passer or border entry and exit laissez-passer or other valid entry and exit documents); (iii) Business registration certificate for traders.- Photo of the border resident or legal representative of the trader: 02 (two) photos size 4x6.
Within 07 working days from the date of receipt of a complete and valid dossier, the Department of Industry and Trade or the agency authorized by the Department of Industry and Trade, based on local market demand, and the ability to arrange business locations at the border market (location), is responsible for considering, confirming the trader's business at the border market (location) according to the form specified in Appendix II attached to this Circular or not confirming and stating the reason.
- In case the dossier is incomplete or invalid, within 03 working days from the date of receipt of the dossier, the Department of Industry and Trade or the agency authorized by the Department of Industry and Trade shall send a written request to the trader or border resident to supplement.- If additional time is needed to seek consultation with relevant agencies of Vietnam and China, the Department of Industry and Trade or the agency authorized by the Department of Industry and Trade shall notify in writing the trader or border resident.
