Order and Procedure for Sealing Exhibits

An exhibit may be sealed and unsealed one or several times. After each unsealing, upon the conclusion of using the exhibit, it must be resealed in accordance with the proper procedures and sent back to the location where the exhibit is stored.

The sealing of evidence shall be carried out in the following steps and procedures:

Step 1: Preparation for Sealing Evidence

- The organizer responsible for sealing the evidence shall invite or summon individuals to participate in the sealing of the evidence;- Prepare necessary conditions for sealing the evidence.

The chairman organizing the sealing of evidence must direct the preparation of necessary tools and means to serve the sealing, to seal papers, to preserve, and to transport the evidence.

Step 2: Sealing the Evidence

- Check the evidence to be sealed, providing a specific, complete, and accurate description of the condition of the evidence in the evidence sealing report;- Package or seal the evidence to be sealed (in cases where the evidence can be packaged or sealed);- The persons organizing the sealing, participating in sealing the evidence, shall sign, clearly state their full names or affix fingerprints (with annotations of the fingerprinted person's name) on the sealing papers (written or fingerprinted clearly with indelible ink);- Affix the seal of the agency, organization conducting the sealing of the evidence or of the commune-level government, ward, or commune-level town where the evidence sealing is conducted on the sealing papers;- Paste the sealing papers;- For packaged or sealed evidence, the sealing papers must be pasted over the parts that can be opened to access the evidence or can be tampered with to alter the integrity of the evidence;- For evidence of large volume, size, or immovable, the sealing papers must be pasted over important parts that determine the origin, characteristics of the evidence, and the joints of the evidence;- Depending on specific cases, protective measures for the sealing papers must be taken suitably for transportation and preservation conditions.- Examine the seal of the evidence (the sealing papers must ensure they are not torn, deformed; and the information recorded on the sealing papers must not be lost or altered).

Step 3: Finalizing the Sealing of Evidence

- Make an evidence sealing report. The report must accurately describe the condition of the evidence before and after sealing, contain the full signatures, full names, or fingerprints (with annotations of the fingerprinted person's name) of those organizing, participating in sealing the evidence in accordance with legal regulations and this Decree;- The report is made, included in the case file, and one copy is provided to the individual, agency, or organization with rights, obligations, responsibilities related to the sealed evidence.

Decree 127/2017/ND-CP takes effect from January 1, 2018.
