Online public services regarding land from August 1, 2024

Specifically, in Article 55 of Decree 101/2024/ND-CP, the online public services regarding land in Vietnam are regulated as follows:

- Online public services regarding land are implemented through the National Public Service Portal, the Public Service Portal of the Ministry of Natural Resources and Environment, and the Provincial Public Service Portals.

- The managing authority of the Public Service Portal identifies and announces the regulations on electronic identification and authentication of the entities participating in online public services regarding land transactions on the Public Service Portal and complies with the regulations of the law on electronic identification and authentication.

- The Ministry of Natural Resources and Environment publicly announces the list of online public services regarding land, the level of provision of full or partial online public services for agencies, organizations, and individuals to know.

- Based on specific conditions of information technology infrastructure and land database management, the authority responsible for receiving applications and returning administrative procedure results regarding land has the responsibility to organize the reception of applications and the return of administrative procedure results in the electronic environment according to the regulations of the Government of Vietnam.

- The connection, data sharing, and electronic integration among agencies to handle administrative procedures are implemented according to the regulations of the law on the implementation of administrative procedures in the electronic environment and the law on the implementation of the one-stop, inter-agency mechanism.

Regulations on Electronic Transactions Regarding Land in Vietnam

- Electronic transactions regarding land include land transactions conducted by electronic means through information systems serving electronic transactions. Electronic land transactions are carried out when they meet the conditions allowing parties to perform transactions according to the regulations of the law on electronic transactions.

- Agencies, organizations, and individuals participating in electronic land transactions must comply with the regulations of the law on electronic transactions, the law on cybersecurity, and other relevant legal regulations.

Regulations on Disclosure of Land Information and Data in Vietnam

- The National Land Information Portal is a part of the National Land Information System, used to disclose, share, and provide services to exploit and use land information and data from the national land database. The Land Registration and Information Data Department, Ministry of Natural Resources and Environment publishes the following information and data on the National Land Information Portal:

+ List of information and data under the national land database;

+ Information on land use planning, announced land price tables; information on administrative procedures in the land sector; legal documents on land;

+ Open data from the national land database.

- The Provincial People's Committee is responsible for publishing on the website of the Provincial People's Committee or the website of the Department of Natural Resources and Environment the following information and data:

+ List of information and data under the provincial land database management;

+ Information on land use planning, announced land price tables; information on administrative procedures in the land sector; legal documents on land;

+ Open data under the provincial land database management.

- The publication of the list of land information and data must comply with the regulations on state secret protection in the land sector and other relevant legal regulations.
