Officials not participating in organization of high school graduation exam in Vietnam but providing answers to candidates will be dismissed from February 8, 2025
According to the provisions of Article 56 of the Regulation issued under Circular 24/2024/TT-BGDDT, the handling of individuals participating in the examination organization and related individuals violating the Regulation on high school graduation examinations is as follows:
- Participants in organizing the exam who are officials and public employees with acts of violating the Examination Regulation (detected during or after the exam) will be suspended from examination-related duties and recommended to the agency managing officials and public employees to apply the provisions of the law regarding officials and public employees to discipline them through the following forms:
+ Reprimand for those who commit first-time offenses below the level specified in points b, c, d, clause 1, Article 56 of the Regulation issued under Circular 24/2024/TT-BGDDT while performing their duties;
+ Warning for those who commit one of the following errors: Allowing candidates to cheat and bring unauthorized documents, items into the examination room as stipulated in point b, clause 4, Article 21 of the Regulation issued under Circular 24/2024/TT-BGDDT; marking exams inconsistently with grading guidelines or making numerous mistakes in scoring; setting exam questions outside the content specified in clause 2, Article 4 of the Regulation issued under Circular 24/2024/TT-BGDDT; transmitting exam data incorrectly, untimely, not conforming to the Ministry of Education and Training’s standards;
+ Depending on the level of violation, there may be a reduction in salary grade, demotion, dismissal, or transfer to other work for those who commit one of the following errors: Setting exam questions inconsistent with the scientific content of the exam/test; directly solving the exam questions or guiding candidates during the exam; giving one candidate’s exam to another; fraud in marking exams, grading not conforming, exceeding the framework or downgrading the candidate’s score;
+ Dismissal or prosecution recommendation for criminal liability for those with one of the following acts: Leaking exam questions outside the exam area or bringing solutions from outside into the examination room during exams; leaking exam questions, buying, selling exam questions; leaking exam number codes; altering, adding, or deleting candidates’ answers; intentionally altering marks on exams, examination records, or score sheets; swapping examination papers, exam number codes, or candidates’ scores; fraudulent alterations of student records, candidate profiles;
+ Those who lose candidates’ exam papers when collecting, transporting and preserving, or marking exams or have other violations in the examination organization depending on the nature and level of violation, will be disciplined in one of the disciplinary forms stipulated in Article 56 of the Regulation issued under Circular 24/2024/TT-BGDDT.
- Public employees not participating in the exam organization but committing acts such as: Taking exams for others, organizing the removal of exam questions and inserting solutions, disseminating false information adversely affecting the exam, disrupting order at the exam site will be administratively fined and proposed for dismissal.
- Participants in the organization and those related to the examination who are not officials and public employees with acts of violating the Examination Regulation (detected during or after the exam), depending on the severity, will be administratively fined by the competent authority and dealt with according to labor laws; may be temporarily suspended from studies or expelled (if they are students or trainees) when committing violations specified in points b, c, d, e, clause 1, Article 56 of the Regulation issued under Circular 24/2024/TT-BGDDT.
- The forms of handling violations stipulated in clauses 1, 2, and 3 of Article 56 of the Regulation issued under Circular 24/2024/TT-BGDDT are decided by competent authorities following the prescribed procedure. In addition to the above sanctions, the competent authorities may prohibit holding positions related to the examination for 1 to 5 years.
