Recently, the Government of Vietnam promulgated Decree 94/2013/ND-CP detailing the implementation of the Law on National Reserves.

Decree 94/2013/ND-CP stipulates that Civil servants, public employees, having worked at specialized national reserve management agencies for 5 years (60 months), and Military personnel, people’s police with 5 years (60 months) working in national reserve tasks shall be eligible for seniority allowance. The period for calculating seniority allowance is regulated as follows:
- Time working at specialized national reserve management agencies, working in national reserve tasks under the Ministry of National Defense, Ministry of Public Security;- The period of seniority allowance in other professions is cumulated with the time specified at Point a of this Clause to calculate seniority allowance including: time serving in the army, police enjoying seniority allowance, time working with salary classification in one of the grades or titles of the specialized fields of customs, cipher, court, prosecution, audit, inspection, civil judgment enforcement, forestry protection, Party inspection, and educators (if any);- Time performing military service in accordance with the law where before performing military service one enjoyed seniority allowance.
At the same time, those who are engaged in national reserve tasks as stipulated and have worked for a period eligible for seniority allowance for 5 years (60 months) shall enjoy a seniority allowance of 5% of the current salary plus the allowance for leadership positions and excess frame seniority allowance (if any); from the 6th year onwards, each year (full 12 months) will be calculated with an additional 1%.
Besides, this Decree stipulates periods not counted for seniority allowance as follows:
- Probationary period or the period of fixed-term working contract;- Time off work without pay continuously from 01 month or more;- Sick leave, maternity leave exceeding the time limit as prescribed by social insurance law;- Time being temporarily suspended from work or being detained, held for investigation, prosecution, and trial.
