Regarding this issue, LawNet would like to answer as follows:
On December 7, 2023, the Government issued Decree 85/2023/ND-CP amending Decree 115/2020/ND-CP on the recruitment, use, and management of public employees.
Decree 85/2023/ND-CP officially abolished regulations on examinations for promotion of professional titles of public employees, leaving only regulations on consideration of promotion of professional titles from lower ranks to adjacent higher ranks in the same career field.
Specifically, Point c, Clause 38, Article 1 of Decree 85/2023/ND-CP stipulates:
Abolish the phrases: "take the exam or" in Clause 2, Article 29, Article 31, Article 34, Article 35, Article 36, Article 37, Article 38, Clause 3, Article 62, Clause 2, Article 67; “and salary rankings for professional positions of public employees in management branches and fields, after obtaining the consensus of the Ministry of Home Affairs” in Clause 3, Article 64; “according to Form No. 01 issued with this Decree” in Clause 4, Article 14.
Thus, as of December 7, 2023, the public employee promotion exam has officially been abandoned. Therefore, changing a professional title from a lower rank to an adjacent higher rank in the same occupational field is only carried out in the form of consideration for public officer rank promotion.
According to Clause 16, Article 1 of Decree 85/2023/ND-CP amending Article 32 of Decree 115/2020/ND-CP, standards and conditions for registering for consideration for professional title promotion are as follows:
- An officer can register for consideration for promotion to an adjacent higher professional title when meeting the following standards and conditions:
+ Graded in quality at the level of completing tasks well or better in the working year immediately preceding the year of consideration for professional title promotion; have good political qualities and professional ethics; not within the disciplinary period; not during the implementation of regulations related to discipline according to the Party's regulations and the law;
+ Have the capacity, professional qualifications, and skills to hold a professional title at a higher level adjacent to the current professional title level in the same professional field;
+ Meet requirements for diplomas, certificates, and other professional title standards for promotion consideration. If, at the time of promotion consideration, the Ministry managing professional titles of specialized public employees has not issued regulations on the content, program, form, and duration of training according to the provisions of Clause 1, Article 64 of Decree 85/2023/ND-CP, it is not required to meet the requirements for a professional title training certificate; officials considered for promotion are considered to meet the standards and conditions of the considered class;
+ Meet the requirements for minimum working time holding the adjacent lower-class professional title according to the requirements of the professional title standards for promotion consideration, except in the case of consideration for promotion of a professional title in which that professional title, according to regulations at the time of consideration, does not have an adjacent lower rank.
In case an employee has worked for a period of time before being recruited or accepted (excluding the probationary period as prescribed in Clause 2, Article 21 of Decree 85/2023/ND-CP), in accordance with the law, pay mandatory social insurance, work in a job position that requires appropriate professional qualifications and skills (if there is intermittent working time without receiving a one-time social insurance benefit, it will be accumulated), and that time will be calculated as the basis for salary ranking at the current professional title, which is considered equivalent to the current professional title class.
In order to calculate the equivalent time, there must be a period of holding a professional title of a lower class adjacent to the professional title class being considered for at least 12 months up to the deadline for submitting the registration application for consideration for promotion.
- In addition to the above standards and conditions, the Ministry managing professional titles of specialized public employees is responsible for specifying standards and conditions for promotion consideration in cases of promotion to class II and class I in the management industry or field. These are associated with the requirements of the job position corresponding to the proposed professional title class, ensuring the requirements for improving the quality of the team and employee benefits.
The Ministry of Home Affairs specifically stipulates standards and conditions for promotion consideration in cases of promotion to class II and class I applicable to administrative officers, clerical officers, and archives officers.
For rank V public employees and class IV public employees, they will be considered for promotion to the adjacent higher professional title class if they are working in an employment position appropriate to the professional title being considered and meet the standards and conditions for consideration.
In cases where public employees are ranked in a professional title class but this professional title class is no longer prescribed by current law, they will be considered for promotion to a higher professional title class adjacent to the current professional title class if they are working in a suitable job position and meet the above standards and conditions. This regulation does not apply to cases where there is a change in occupational title codes.
