On January 5, 2024, the Ministry of Home Affairs issued Official Dispatch 64/BNV-CCVC determining the structure of civil servant ranks and the structure of civil servant professional titles.

1. Instructions for determining the structure of civil servant ranks in Vietnam

The civil servant rank structure is calculated according to the percentage of civil servants holding civil servant ranks to the total number of civil servants in each agency, organization, and unit employing civil servants (abbreviated as employing unit), specifically:

- For user units under Ministries, Ministerial-level agencies (hereinafter referred to as Ministries), and Government agencies

+ For organizations performing in-depth advisory functions on state management of industries and fields:

++ Rank of senior specialist and equivalent: maximum no more than 30%;

++ Main specialist and equivalent rank: maximum no more than 50%;

++ Rank of specialists, officers, employees, and equivalent: maximum not more than 20%.

+ For organizations performing general advisory functions or internal management:

++ Rank of senior specialist and equivalent: maximum no more than 25%;

++ Main specialist and equivalent rank: maximum no more than 50%;

++ Rank of specialists, officers, employees, and equivalent: maximum not more than 25%.

- For specialized agencies, administrative agencies, and organizations under the Provincial People's Committee

+ For specialized agencies under the People's Committee of centrally run cities:

++ Main specialist and equivalent rank: maximum no more than 50%;

++ Specialist rank and equivalent or below: maximum no more than 50%.

+ For specialized agencies, administrative agencies, and organizations under the Provincial People's Committee:

++ Main specialist and equivalent rank: maximum no more than 40%;

++ Specialist rank and equivalent or below: maximum no more than 60%.

- For specialized agencies, administrative agencies, and organizations under the district-level People's Committee:

+ Specialist level and equivalent: maximum no more than 80%;

+ Rank of officers, employees, and equivalent: maximum no more than 20%.

2. Instructions for determining the structure of public employee professional titles in Vietnam

Determining the structure of civil servant professional titles is carried out according to the instructions in the Circulars of the Ministries managing industries and fields. In cases where there is no guidance or there is guidance but the percentage in each professional title class has not been specifically determined, it is agreed to do the following:

- For public service units that self-guarantee regular expenditures and investment expenditures (autonomous units group 1) and public service units that self-guarantee regular expenditures (autonomous units group 2)

+ Professional titles in class I and equivalent: maximum no more than 20%;

+ Class II professional titles and equivalent: maximum no more than 50%;

+ Professional titles of class III and equivalent or lower (if any): maximum no more than 30%.

- For public service units that cover part of their regular expenses (autonomous units group 3) and public service units whose regular expenses are guaranteed by the state budget (autonomous units group 4).

+ Professional titles in class I and equivalent: maximum not more than 10%;

+ Class II professional titles and equivalent: maximum no more than 50%;

+ Professional title level III and equivalent or lower (if any): maximum not more than 40%.

Note:

- The structure in Sections I and II of Official Dispatch 64/BNV-CCVC dated January 5, 2024 does not include leadership, management, or management civil servants.

- Hanoi National University, Ho Chi Minh City National University, Vietnam Academy of Social Sciences, Vietnam Academy of Science and Technology, other agencies, organizations, and units under or under the Ministry, ministerial-level agencies, Government agencies, and agencies under the Provincial People's Committee and District People's Committee are established in accordance with the provisions of the law and decide according to authority or based on the decision of the competent authority to determine the ratio corresponding to the ratio of the agencies, organizations, and units mentioned above.

For units under or under the agencies mentioned in Section I and Section II of Official Dispatch 64/BNV-CCVC dated January 5, 2024, and in Clause 2, Section III of Official Dispatch 64/BNV-CCVC dated January 5, 2024, the head of the agency or organization will base the allocation of the appropriate rate on the functions, tasks, and actual situation of the agency, organization, or unit, ensuring the appropriate rate according to the law.

- In case there is not enough proportional numbers for each civil servant rank or each employee professional title class, the missing number will be added to the adjacent lower rank (rank) and may be larger than the prescribed ratio. In case the actual number exceeds the above ratio, the examination, promotion consideration, or promotion to the civil servant rank or professional title class that exceeds the ratio will be temporarily not held.

- Competent agencies of the Party, Vietnam Fatherland Front, and socio-political organizations are based on the instructions in this Official Dispatch to consider and decide on the application of determining the ratio of civil servant rank structure and civil servant professional title class structure in agencies, administrative organizations, and public service units under the scope of management.
