Obligations of Passenger Transport Business Entities by Train

This is a notable content mentioned in Circular 34/2019/TT-BGTVT issued by the Minister of Transport amending and supplementing a number of provisions of the Circulars regulating inland waterway transport.

According to the provisions of Circular 34/2019/TT-BGTVT, organizations and individuals engaged in the business of transporting passengers, luggage, and parcels by high-speed passenger ships between ports, terminals, and waters within the inland waters of Vietnam and across borders on fixed routes must fulfill the following obligations:

- Publicize information on the quality of passenger transport services, luggage, and parcels on the website of the organization or individual or by posting at the port, terminal, or ticket booth so that passengers are informed before boarding.- Post at the port, terminal, and ticket booth in Vietnamese and English: information on departure times, number of trips, ticket prices, discount policies according to the law and transport operator, itinerary (including stopover points, stopover times), services provided to passengers on the journey, passenger insurance, free baggage allowance, and the hotline number for passenger feedback.- Post on the ship in Vietnamese and English: the hotline number of the organization, individual, managing authority, search and rescue unit, and onboard regulations.- At least 10 minutes before the ship departs from the port or terminal, the service staff or crew on the ship are responsible for guiding and providing information on onboard regulations, locations, and use of firefighting equipment, lifesaving equipment, sinking escape tools.- At least 10 minutes before the ship arrives at the port or terminal to drop off passengers, the service staff or crew on the ship are responsible for providing information on the port, terminal, stopping time, and other necessary information.- Manage and store required information, and provide complete required information to relevant Departments of Transport, the Vietnam Maritime Administration, the Vietnam Inland Waterways Administration, and related port authorities when requested. Required information includes: details of the ship's arrival and departure times, itinerary, passenger list, crew list, and service staff on each trip and must be stored for 01 year.- Notify in writing to the Department of Transport and related port authority, and post at the ports and terminals for passenger pickup and drop-off:

- At least 10 days before commencing passenger transport on a fixed route;- At least 03 days before changes in the train schedule or itinerary, at least 12 hours before changes in departure times;- At least 5 days before ceasing operations on the route.

- Notify the relevant port authority and related units about ship incidents during the route.- Annually organize drills for emergency response to ship incidents such as collisions, engine failures, fires, and explosions.- Other obligations prescribed in Clause 2, Article 82 of the Law on Inland Waterway Transport.
