Number of Deputy Heads of departments of public service providers in Vietnam

This is the main content specified in Decree 120/2020/ND-CP regulating the establishment, reorganization, and dissolution of public service providers in Vietnam, issued on October 07, 2020.

The Number of Deputy Heads of departments of public service providers in Vietnam is stipulated in Decree 120/2020/ND-CP as follows:

- For departments under public service providers that are self-sufficient in covering both recurrent and investment expenditures: the number of Deputy Heads shall follow the Establishment Scheme (in the case of new establishment) or the autonomy Scheme of the unit approved by the competent authority in Vietnam;

- For departments under public service providers that are self-sufficient in covering recurrent expenditures, no more than 02 Deputy Heads shall be appointed;

- For departments under public service providers partially covering their own recurrent expenditures or those whose recurrent expenditures are covered by the state budget: with 07 to 09 working public employees, 01 Deputy Head shall be appointed; with 10 or more working public employees, no more than 02 Deputy Heads shall be appointed.

Based on the aforesaid framework for the number of Deputy Heads (excluding units under the organizational structure of ministries and ministerial-level agencies), the Minister, the Head of ministerial-level agencies, agencies under the Government of Vietnam, the head of organizations established by the Government of Vietnam or the Prime Minister that are not public service providers, the People’s Committee and the Chairman of the provincial People’s Committee, and the district-level People’s Committee shall determine the specific number of Deputy Heads of public service providers under their management scope according to the following criteria:

- Legal position, functions, tasks, and authorities of the public service provider;- Scale in terms of the number of working staff and the affiliated organizational units of the public service provider;- Scope of operations, nature, and characteristics of the professional and operational activities of the public service provider in Vietnam.
